than this available. The carport could be moved back away from the property line,
but the staff feels nothing would be gained by requiring this. There is a preced-
ent for this in the Amador Apartments on St. John Street. The staff recommends
that the application be approved. Upon motion of Commissioner Lozano, seconded by
Commissioner Antonini, the following resolution was unanimously adopted by those
Co®aisaionera present:
RESOLUTION N0. 249
WHEREAS, the application of Mr. Dan Canniatraci, 3460 Village Drive,
Castro Valley, fora Variance from Section 16.602, Ord. No.
309, in order to locate an accessory building within five feet of the
property line, in connection with construction of a 15-unit multiple
dwelling, located at 755 Roae Avenue, in an RG-15 District, has come
before this Commission;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The Variance ie hereby granted subject to the following
conditions:
a. The accessory building moat be free-standing, and must
in no way be attached to or supported by the rear or
side lot fences.
b. The accessory building must conform in all respects,
to the Building Code, and a building permit moat be
secured for said structure.
Chairman Landon then opened the public hearing on the application of Mr. Reno Cairo,
4355 Second Street, for a Variance from Section 16.602, Ord. 309, in order to allow
construction of an accessory building (carport) within five feet of the aide lot
line, at the above location, in an R-2 District. No one spoke from the audience,
and Chairman Landon declared the public hearing closed. Mr. Campbell was called
upon for the staff report and stated the subject property is in an older section of
the City, and the lot is substandard both in area and width. He quoted from
Section 19.1000 of Ordinance No. 309, which refers to "narrowness, shallowness
and unusual shape" of a lot causing undue hardship; the staff feels this section
of the Ordinance is applicable. Mr. Campbell stated further that variances of this
type have been approved on Division Street. The subject carport would be 18 inches
from the property line, as is an existing garage on the property. The staff recom-
mends approval of this Variance with the condition that the construction meets all
requirements of the Building Code. Mr. Ted Fairfield, of Macl.,~y & Somps, was present in the audience and
stated that the staff felt this property should have some type of R-1 use: Planned
Unit Development or a R-1 subdivision with variances. The Tentative Map is on an
R-1 basis with the variances necessary to be applied for at a future Planning Com-
mission meeting. It is proposed to have six R-1 lots with a minimum width of 50 ft.;
the seventh lot is a common area (undivided interest) which replaces the back yards
