RESOLUTION N0. 264 <br />WHEREAS, the application of Mra. Anna Brown, 460 Division St „ for e <br />Variance from Section 17.700, Ord. No. 309, in order to allow <br />installation of an illuminated 15"x30" advertizing sign on an S-ft, pole <br />within the required front yard setback at the above location in an RG•15 <br />District, has come before this Commission; <br />NOW, THEREFORE, BE IT <br />RESOLVED, that the City Planning Commission does hereby grant said <br />Variance subject to the following condition: <br />1. The sign must be installed in exact accordance with the <br />sketch submitted with the Variance application, and said <br />sign must be at least 7 feet from the edge of the sidewalk. <br />Chairman Landon then proceeded to the application of Merle Ahern, 3713 Encline Waq, <br />Belmont, fora Zoning Permit with Site Plan and Architectural Approval in order to <br />construct eight multiple dwelling unite at 4795 Harrison St „ in an RG-15 District. <br />Mr. Campbell, in giving the staff report, stated this is the same property for which <br />the Commission hoe already granted a Variance and Zoning Permit. The previous <br />Variance and Zoning Permit were issued under the name of Chris Beratlie and showed <br />him as the record owner. Mr, Beratlie hoe been contacted recently and said Mr. <br />Sauger ie still planning to build on the subject property. No building permit has <br />been issued, although Mr. Sauger indicated during the past week that he is still <br />planning to proceed with the project. Mr. Ahern was present in the audience end <br />explained he ie in the process of buying the property from John T. Koploe, who is <br />Chris Beratlie' brother-in-law. A down payment has been made on the property and <br />it is in escrow pending approval of Mr, Ahern~a Zoning Permit application by the <br />Planning Commission. Chairman Landon obtained verification from City Attorney <br />Struthers of the fact that variances and zoning permits go with the property even <br />if it has been sold, In this instance, however, the necv prospective owner wishes <br />to submit new plena for a different number of unite from that granted previously. <br />Mr. Struthers said the Planning Commeaion moat be cautious and determine the legal <br />owner. Chairman Landon said if the Planning Commission receives notification from <br />the original owner that he withdraws hie interest in the Variance and Zoning Permit, <br />then the new owner may submit an application. It was moved by Commissioner <br />Antonini, seconded by Commissioner Wipfli, and carried, that the application of <br />Merle Ahern for a Zoning Permit for a Zoning Permit with Site Plan and Architectural <br />Approval in order to construct eight multiple dwelling units at 4795 Harrison St. <br />in an RG-15 District, be continued to the Planning Commission meeting of January 22, <br />1964. <br />The next item brought up was the application for a Zoning Permit by Mre. Anna Brown, <br />460 Division St., in order to allow installation of a 15"x30" illuminated sign <br />within the front yard setback at the above address. Mr. Campbell said the staff <br />recommends granting the Zoning Permit subject to the condition that a building permit <br />is obtained, Upon motion of Commissioner Wipfli, seconded by Commissioner Lozano, <br />the following resolution was unanimously adopted by those Commissioners present: <br />RESOLUTION N0, 265 <br />WHEREAS, the application of Mra, Anna Brown, 460 Division St., for a <br />Zoning Permit in order to install a 15"x30" illuminated sign <br />within the front yard setback at the above address, hoe come before <br />this Commission; <br />NOW, THEREFORE, BE IT <br />RESOLVED, that the Planning Commission does hereby grant said Zoning <br />Permit subject Co the following condition: <br />1. Mr. Campbell presented to the Commi.aeion a memorandum from City Manager <br />Falea dated December 20, 1963, which contained recommendations for amendments to <br />Ordinance No. 309 is ordez to provide for mandatory installation of underground <br />
