6. Details of construction of all apparatus and fences indicated on <br />the approved plan shall be submitted for approval by the City <br />Engineer prior to construction. <br />7. A drinking fountain shall be installed within the park area, Said <br />installation shall be of a type and in a place approved by the City <br />Engineer. <br />8. Unless existing, all Eucalyptus and Modesto Ash trees indicated on <br />the approved plan shall be eliminated and replaced by a specie of <br />tree approved by the City Street Tree Committee. <br />9. Aground cover for the picnic areas indicated on the approved plan <br />shall be determined by the applicant, approved by the City Engineer, <br />and installed. <br />10. Any proposed changes in the approved park development plan on file <br />with the City, other than those required by the Conditional Uae <br />Permit, must be referred to the City Planning Coamd.asion for specific <br />approval prior to their implementation. <br />11. Said Conditional Uae Permit shall be for a period of five years from <br />the date of issuance. <br />12, Arrangements for liability insurance foz said park area, after <br />completion, shall be submitted by the applicant to the City Council <br />for approval. <br />13. The City of Pleasanton will not assume any responsibility for the <br />maintenance of said park area until the entire approved plan has <br />been completed to the satisfaction of the City, and until all of the <br />above conditions have been met, <br />Chairman Landon opened the public hearing on the application of George Marment, <br />403 Oak Lane, Pleasanton, for a Conditional Use Permit, under Section 16.200(2), in <br />order to enlarge an existing non-conforming use by adding two unite to an existing <br />multiple dwelling located at 187 and 195 Bernal Avenue, in an R-1 District. Mr. <br />Marmeat was present in the audience. There being no co®enta from the audience, it <br />was moved by Commissioner Antonini, seconded by Commissioner Lozano, and carried, <br />that the public hearing be closed. Mr, Fales quoted from Section 16.200 of Ord, No. <br />309, and stated that the staff questions whether the proposed construction is a <br />"necessary or incidental extension" as provided for in Section 16.200(2), and, <br />therefore, whether a Conditional Use Permit is applicable. Upon consultation with <br />the City Attorney, the applicant was allowed to present his case to the Commission. <br />If the Commission does not grant the Conditional Uae Permit, rezoning would be the <br />next step toward additions to thin property, The subject property may be part of <br />the downtown core area in the future, and the staff recommends rezoning to C-C. <br />The application could then be reactivated under a C-C zoning rather than as a non- <br />conforming use in a R-1 District. It was the consensus of the Commission that a <br />non-conforming use in an R-1 District should not be expanded at thin time, whereupon <br />Mr. Marment withdrew his application with the privilege of resubmitting it under <br />C-C zoning when and if such is designated.
