<br />WHEREAS, the application of Chris Beratlis, 550 Main St., fora Variance
<br />from Section 16.700, Ord. No. 309, in order to allow the con-
<br />struction of two single-family dwellings with a reduced Bite width at
<br />366 Christina Court, in an R-1 District, has come before this Commission;
<br />NOW, TNIItEFORE, BE IT
<br />RESOLVED, that the above-named Variance is hereby granted subject to the
<br />following conditions:
<br />1. All conditions specified by the Subdivision Committee
<br />in approving Minor Subdivision application MS64-4,
<br />approved October 20, 19b4, moat be met.
<br />2. Reciprocal easements must be granted by each of the
<br />two lots involved in order that each lot will have a
<br />20-foot wide driveway from the street.
<br />Chairman Landon then opened the public hearing on the application of Pleasanton Mills,
<br />Inc., P.O. Sox 397, Pleasanton, for a Conditional Use Permit under Section 4.303,
<br />Ord. No. 309, in order to construct a steel grain storage facility on property
<br />located in the vicinity of Mohr and Oakland Avenues, in an A District. Mr. Pales,
<br />in giving the staff report, stated that the subject property lies within a future
<br />residential district according to the proposed General Plan; however, it ie dif-
<br />ficult to determine how soon the land use in this area will change. Approval of
<br />this permit should be related to a time limit. Lot area and width requirements of
<br />Ord. No. 309 are met. Rowever, a height of 50 ft. is proposed, and Section 18.200
<br />states that height Limits fixed elsewhere in this Ordinance (2~ stories or 30 ft.)
<br />shall not apply to "Berne, silos or other farm buildings at least 50 feet from every
<br />lot line." The proposed structure would appear to fit this category, although this
<br />cannot be determined from the site plan submitted. The staff recommends that the
<br />public hearing be continued until a fully developed site plan is received from the
<br />owner of the property which would indicate more precisely the setbacks and lot
<br />dimensions, and a determination could then be made whether oz not variances are
<br />required. Mr. D,E. Douglas, of Pleasanton Mills, said he will have the exact meas-
<br />urements determined for the Commission. City Attorney Struthers referred to
<br />Section 18.200 of the Zoning Ordinance which contemplates the subject type of
<br />structure, and stated that if it is an integral part of existing use the height
<br />proposed would be allowable. Following discussion by the Commission, it was moved
<br />by Commissioner Antonini, seconded by Commissioner Lozano, and carried, that the
<br />public hearing on the above matter be continued to the meeting of November 12, 1964,
<br />at which time a detailed site plan shall be presented.
<br />The Commission then discussed elimination in the future of Bite plane with incomplete
<br />information being presented for Commission consideration. It was moved by Coa®is-
<br />aioner Lozano, seconded by Commissioner Johnston, and carried, that henceforth no
<br />Zoning Ordinance application shall be accepted for presentation to the Commission
<br />ualeae and until it ie accompanied by properly completed site plena, architectural
<br />and landscaping plane, where such ie required by the Ordinance.
<br />Chairman Landon opened the public hearing on the application of V.E. Scribner, 542
<br />Bonita Ave., for a Variance from Section 7.500, Ord. No. 309, in order to construct
<br />a duplex with reduced rear and front-yard setbacks, at the southwest corner of
<br />Rottinger Drive and Pico Avenue, in an R-2 District. Mr. Falea, in giving the staff
<br />report, stated that the Variances requested are for a rear-yard reduction from 25 ft.
<br />to 7 ft., and a front-yard reduction from 25 ft, to 20 ft. The proposed lot ie 17.57.
<br />larger in area than the minimum duplex Lot permitted by the Zoning Ordinance. T.he
<br />applicant proposes to construct 1125 aq.ft. (including 3 bedrooms) of floor area in
<br />each unit of a duplex plus two 2-car garages. The staff concludes that the granting
<br />of this Variance might set a trend for the development of R-2 lots in this new area
<br />of the City, and recommends that the Variance be denied on the basis that no extra-
<br />ordinary conditions exist *_o warrant a Variance from the requirements of the Zoning
<br />Ordinance. Mr. Scribner was present in the audience, and stated that he plane a
<br />central court in lieu of a rear yard. Mr. Struthers said a 5 ft. reduction in fzont-
<br />yard setback is permissible in 257, of lots. There being no further comments from
<br />the audience, it was moved by Co®isaioner Antonini, seconded by Commissioner Lozano,
<br />and carried, that the public hearing be closed. After discussion by the Commission,
<br />upon motion of Comniaeioner Antonini, seconded by Commissioner Lozano, the following
<br />resolution was adopted by the following vote: AYES: Commissioners Antonini, Johnston.
