<br />WHEREAS. the application of Tele-Vue Syeteme of Pleasanton, P.O. Hox
<br />2178, Dublin, for a Conditlonal Uae Permit, under Section 4.309,
<br />Ord. No. 309, in order to Locate a Community Television Antenna upon a
<br />pa:c.b if property located west of Foothill Road and south of Bernal
<br />Avenue, in an A District, has come before this Commission;
<br />NOW, THEREFORE, BE IT
<br />RESOLVED, that the above-named Conditional Uae Permit ie hereby granted
<br />subject to the following conditions.
<br />1. Applicant moat maintain and increase tree cover ae necessary
<br />to prevent ae nearly ae poaeib?e any change in the present
<br />view characteristics of the area both from the valley floor
<br />and from the adjacent ridge area.
<br />2. Permission of the property owner is required.
<br />Chairmen Landon opened the public hearing on the application of the Planning Com-~
<br />mission for an amendment to Otd. No. 309 aeeignl.ng zoning districts to the area of
<br />Annexation No. 37, "Golden Eagle Annex". Mr. Fales stated the staff recommends
<br />t::at the area taithin the subject annexation be assigned the A, Agricultural Zoning
<br />Dis*rict designation. There being no comments from the audience, it was moved by
<br />Gommiseioner Lozano, seconded by Commissioner Johnston, and carried, that the public
<br />hearing be closed. Upon motion of Chair:mn Landon, seconded by Commissioner
<br />Antonini, the following resolution was adopted by unanimous vote:

<br />RESOLVED:
<br />The City Planning Commission, on its own motion, after the
<br />required public hearing, hereby recomsends to the City Council
<br />that the area within Annexation No. 37, "Golden 8agle Annex",
<br />be assigned the A, Agricultural Zoning District designation
<br />by amendment to Ordinance No. 309, in accordance with existing
<br />annexation agreements with Che several property owners involved.
<br />The following matter having been moved to the next position on the agenda. Mr. Falea
<br />proceeded to give the staff reports on the Varlanca and Zoning Permit applications
<br />of Wm. F. Webb, Rt. 1, Bob 404, Pleasanton, in order to construct a car-wash
<br />facility on Lot 10, Vervaia Ave., with a seduced side-yard setback, which ware con-
<br />sidered at the same time. Both applications have been continued from April 28 and
<br />May 12, 1965. The side-yard requirement for a C-T District is 10 ft., whereas the
<br />side on which the Variance is requested is 0 ft. and abate the P.G. 6 E. substation
<br />which 1e aloo zoned C~T; the other proposed aide-yard being 25 ft. The staff recosr
<br />mends that Che Qariance be granted, although the Commission ~y wish eo determine
<br />the use of the entire property before granting the Variance. In giving the staff
<br />report on the Zoning Permit application, Mr. Falee stated that a Coln-operated
<br />car-wash is contemplated for one-half of the property and a one-story building of
<br />unknown ues is being considered for the other half. The parcel, however, i• not
<br />largo enough to be split into two legal parcels in the C-T Zoning District. If
<br />this property were rezoned to C-C, Cooomnity Commercial, this obstacle would be
<br />eliminated, and this would permit a minor subdivision. Mr. H.W. Johnson was
<br />pr~aect ir, t'ir audience, on behalf of the applicant, and cone}derable discussion
<br />anaceed between him, the City Attorney, etsff and Commission. Mr. `itruthera ex-
