then consideration could be given to amending the subject site plan. Chairman <br />Landon explained that following Ord. No. 407 becoming effective on July 7, 1965, <br />a new application for a Conditional Uae Permit will be required. It was moved <br />by Commissioner Landon, seconded by Commissioner Johnston, and carried, that the <br />above matter be continued to the meeting of July 28, 1965. <br />The next item on the agenda was a referral from the City Council for reconsidera- <br />tion of the matter of the appeal of Eesenar Investments of Auburn, 155 Montgomery <br />St., San Francisco, from an Adverse Decision of the Planning Commission denying <br />an application for an amendment to Ord. No. 309 rezoning approximately eight acres <br />located at the southwest corner of Valley Ave. and Santa Rita Road, from the A <br />District to the C-N District. Mr. Campbell sumisarized for the Commission the <br />original report by Livingston and Blayney on this 'rezoning application. Mr. P. <br />Scales, of Easenar Investments, was present in the audience, spoke on behalf of <br />the subject application, and stated that his eomparty has a firm commitment from <br />Safeway. He added that representatives of his orgOnization would be meeting the <br />following morning (June 24) with the CiCy (staff and members of the staff of <br />Livingston and Blayney to discuss their proposed development. Mr. Johnson, re- <br />presenting Western Sierra Lumber Co., was in the audience and presented sketches <br />of proposed commercial development for their property on the northwest corner of <br />Valley Ave, and Santa Rita Road. Upon inquiry by Commissioner Johnston, Mr. <br />Johnson admitted they had no client at the present time interested in the pro- <br />perty, although they had had one in the recent pest. Mr. Johnson stated that even <br />though they are not ae far along in their plans ae Eaeenar Investments, they feel <br />they are far enough along to deserve consideration by the City. Mr. Campbell ex- <br />plained that the City has two extremely strong tools which may be applied to the <br />two properties: (1) With Esaenar Investments, the tool ie rezoning--the City <br />does not have to rezone the subject property. (2) With Western Sierra Lumber <br />Co., the tool ie annexation--the City does not have to annex the subject property. <br />In either case, the City is in a position to get the kind of good development it <br />wants. The question ie whether there is conformance with the General Plan. <br />Essenar Investments' property is within the City limits, while Western Sierra <br />Lumber Company's property ie outside the City. There is an opportunity with either <br />development for the City to get an excellent precedent-setting development. Chair- <br />man Landon explained that in the case of Esaenar Investments, the referral of an <br />appeal to the City Council is being considered, while in the case of Western <br />Sierra Lumber Co., a letter was sent to the City indicating their interest in <br />commercial development of their property, and representatives of Western Sierra <br />have outlined their proposal before the Commission. He stated it is unfortunate <br />that Western Sierra did not discuss their plena with the City earlier. Following <br />consideration by the Com<siesion, upon motion of Chairman Landon, seconded by <br />Commissioner Johnston, the following resolution was adopted by unanimous vote of <br />those Commissioners present: <br />RESOLUTION N0, 436 <br />RESOLVID <br />Upon referral by the City Council of an Appeal by Eeaenar <br />Investments of Auburn, 155 Montgomery St., San Francisco, <br />from an adverse decision of the Planning Commission denying <br />an application for an amendment to Ord, No. 309 rezoning <br />approximately eight acres Located at the southwest corner <br />of Valley Ave. and Santa Rita Road, from the A District to <br />the C-N District, the Planning Commission, after further <br />review, reports and discussion, hereby recommends to the <br />City Council rezoning of the above-named parcel from the <br />A District to the C-N District, with the provision that it <br />be developed under the Planned Unit Development sections of <br />Ordinance No. 309. <br />Mz. Charles Gray, President of American Forest Products Co., was present in the <br />audience, and discussed informally with the Commission and staff alternate uses <br />for the Western Sierra property. Uses suggested by individual Commissioners in- <br />cluded a motel and service station combination, and an expanded building materials <br />facility in conjunction with the existing lumberyard. Chairman Landon explained <br />that C-T or C-G District zoning may be considered. Mr. Campbell stated if an <br />annexation agreement were to be entered into between the property owner and the <br />City, the property owner would have a voice in the determination of a zoning <br />designation. Upon annexation an existing non-conforming use would be allowed <br />to continue for a minimum of 30 years. <br />
