bounded on the north by a small creek, across which is a cemetery; on the west by
<br />Sunol Blvd., across which is an I-P Zone, and on the south by a bird farm. Be-
<br />cause of its size, location and surroundings, the staff feels that a residential
<br />use may not be a realistic, ultimate use, and that a C-0 or I-P use would not be
<br />incompatible. If it were combined with the bird farm it might be possible to
<br />develop both properties together ae residential. Conversely, however, development
<br />of this parcel in a C-0 or I-P use would not necessarily preclude future develop-
<br />ment of the bird farm in residential or in any other use compatible with the
<br />surrounding areas. The staff concludes that the proposed use is appropriate and
<br />recommends approval. However, since the General Plan shows Medium Density for the
<br />subject area, and in the absence of the City Attorney, hie opinion should be
<br />solicited ae to whether rezoning of this parcel might require amendment of the
<br />General Plan. Mr. Lee Amaral, attorney on behalf of the applicant, was present
<br />in the audience, and stated he believed the proposed use ie compatible with the
<br />General Plan. He said further that it is hoped to improve and rent the building
<br />to a civil engineer, architect or someone in a similar type of field. There being
<br />no further comments from the audience, it was moved by Commissioner Johnston,
<br />seconded by Commissioner Lozano, and carried, that the public hearing be closed.
<br />Conmieaioner Rega and Pir. Amaral entered into a discussion about traffic access
<br />to the subject property. Mr. Campbell stated that this is a rezoning application;
<br />development problems have not been considered by the staff es they are taken up
<br />at the time a Zoning Permit application is made. Commissioner Johnston inquired
<br />of Mr. Campbell regarding the possible future widening of Sunol Boulevard. Mr.
<br />Campbell replied that there are plans for its widening but a precise plan has not
<br />yet been developed. However, the major portion of the widening will probably be
<br />across the street from the parcel in question and any widening would have a
<br />negligible effect on the subject property. After discussion by the Commission,
<br />upon motion of Commissioner Lozano, seconded by Chairman Laudon, the following
<br />resolution was adopted by unanimous vote of those Commissioners present:

<br />Regarding the next item on the agenda, the application of Federal Sign and Signal
<br />Corp., 950 30th St., Oakland, for a Zoning Permit in order to install a sign at
<br />273 Spring St., 1n connection with a veterinary hospital, in a C-C District, which
<br />was continued from Jung 9, 1965, Mr. Campbell stated that the staff had received a
<br />telephone call from ti:e applicant, Mr. Owen Tiegen, requesting that the matter be
<br />continued to the meeting of July 14, 1965. It was moved by Chairnan Landon,
<br />seconded by Cocamiesioner Johnston, and carried, that the above application be
<br />continued to the meeting of July 14, 1965.
<br />The next item on the agenda was the application of Michael Stanley, 648 Bonita
<br />Ave., Pleasanton, for a Zoning Permit with Site Plan, Architectural and Landscape
<br />Approval, in order to construct an automobile service station northerly of the
<br />intersection of First and Main Streets, in a C-C District. Mr. Campbell, in pre-
<br />senting the staff report, stated that Ord. No. 407, which will become effective
<br />on July 7, would change the proposed use from a permitted use to a conditional
<br />use in this znri.ng district. Also, the Planning Commission will hold a public
<br />hearing on July 1!+ to consider rezoning this area to C-0. The subject property
<br />is in the path of the proposed Bernal Ave. realignment, and any use that is
<br />started on the property at this time would have to be acquired and removed by
<br />the City in the near future, as there is every indication that the present plane
<br />for realignment rail.l be completed. However, the subject application is a legal
<br />application at this rime and should be reviewed as though Bernal Avenue were not
<br />proposed. The ste2f does not feel that the proposed site is adaptable to an
<br />automobile servicz station because of traffic problems, drainage, and questions
<br />regarding architecture, and recommends denial of this application. Mr. Michael
<br />Stanley was present in the audience, and inquired if a possible time estimate
<br />could be given :gin the Bernal Ave, realignment. Mr. Campbell stated that the City
<br />Council ie prom-ding on the plan for the Bernal Ave. realignment, and the next
<br />step ie the City Council's authorizing the hiring of an appraiser--then the City
<br />will be in a position to negotiate. P4r. R. J. Motto, attorney for the applicant,
