4. Construction Observation <br /> <br />The Architect shall not have control over or charge of and shall not be responsible for <br />construction means, methods, techniques, sequences or procedures, or for safety precautions <br />and programs in connection with the Work, since these are solely the contractor's <br />responsibility under the Contract for Construction. The Architect shall not be responsible <br />for the Contractor's schedules or failure to carry out the Work in accordance with the <br />Contract Documents. The Architect shall not have control over or charge of acts or <br />omissions of the Contractor, Subcontractors, or their agents or employees, or of any other <br />persons performing portions of the Work. <br /> <br />G. ADDITIONAL SERVICES <br /> <br />The consultant shall supply additional services for the City as directed. The full scope <br />and completion schedules of any work shah be agreed in writing prior to initiation of the <br />work. The consultant shall not begin work without written authorization from the City. The <br />consultant shall be paid on the basis of standard hourly billing rates for the work. <br /> <br />Should any of the following services be requested of the Consultant, it shall be considered an <br />Additional Service and shall required written authorization by the City and additional <br />compensation agreed to by the Consultant before it is provided. <br /> <br />1. A service which, by its nature, is impossible to anticipate or evaluate at this time but <br />which would cause a significant increase in the Consultant's working time. <br /> <br />2. A service requested to accommodate a change in plans or design criteria for the <br />project after the design development documents and supporting data have been reviewed, <br />corrected and accepted. <br /> <br />3. A service requested in connection with discussion, evaluation, or disputation between <br />or among the City, bidden, vendors, or contractors about products, prices, or methods of <br />construction other than those drawn and specified by the Consultant. <br /> <br />4. A service requested after completion of the Project and acceptance by the City. <br /> <br />H. CONSTRUCTION COST ESTIMATES <br /> <br />Evaluations of the 0wner's Project Budget, preliminary estimates of Construction Cost and <br />detailed estimates of Construction Cost, if any, prepared by the Architect, represent the <br /> <br />Architect's best judgment as a design professional familiar with the construction industry. <br />It is recognized, however, that neither the Architect nor the Owner has control over the <br />cost of labor, materials or equipment, over the Contractor's methods of determining bid <br />prices, or over competitive bidding, market or negotiation conditions. Accordingly, the <br />Architect cannot and does not warrant or represent that bids or negotiated prices will not <br />vary from the Owner's Project Budget or from any estimate of Construction Cost or <br />evaluation prepared or agreed to by the Architect. <br /> <br /> 4 <br /> <br /> <br />
