Chairman Landon opened the public hearing on the application of Shell 011 Company,
315 Derby Avenue, Oakland, for a Variance from Section 12.500, Ordinance No. 309,
in order to allow construction of an automobile service station with a reduced front,
side and rear yard setback, located at the southeast corner of First Street and
Vineyard Avenue, in a C-T District. Mr. Fales presented the staff report which
pointed out that the applicant desired a Variance in order to construct a pump
island, canopy and service station building partially within the required set-back
lines. The staff felt that some of the conditions requiring the Variances did not,
in fact, exist on the effective date of the ordinance, but were in fact, created by
this proposed development. It was further felt that there were possibilities of
additional property acquisition or re-orientation of the proposed building and
pump island, that would alieviate the necessity for the requested variances. It
was felt that limited variances could be granted on 'this property on the basis of
a well thought out and designed site plan. Air. Dan Crietopolous of Shell Oil
Company, displayed a scale model of the proposed station and pump island. Mr.
Douglas Safreno, also present in the audience, spoke explaining the property Layout.
The staff was questioned regarding the alignment of Ray Street and widening to First
Street, and what plans have been made to carry out this proposal. Mr. Falea in-
dicated that at the present time there were not sufficient funds to complete the
project. It was moved by Commissioner Antonini, seconded by Commissioner Plato,
and carried, that the public hearing be closed. After further discussion by the
Commission, and with the consent of the applicant, upon motion of Chairman Landon,
seconded by Commissioner Plato, and carried, it was determined to continue the
request for Variance and Conditional Use Permit to the meeting of January 26, 1966.
Chairman Landon then opened the public hearing on the application of Pleasanton
Joint School District, 1331 Santa Rita Road, for a Variance from Sections 6.500 and
18.603, Ordinance No. 309, in order to allow construction of a fence along the
Kolln Street frontage of the Alisal Elementary School, in an R-1 District. Mr.
Fales presented the staff report which stated that the school proposed to put in
a four foot high chain link fence with a planting area inside the fence. It is
proposed to have this fence set back four feet from the back of the sidewalk, which
in this case would also be four feet from the property line. This 1s in connection
with the Alisal School, which faces on Santa Rita Road; the portion of the school
property which is adjacent to Kolln Street is all playground. Fencing of the play-
ground area is desirable. The proposal by the school would put more of the area
into the playground where it would be usable and would also be more easily main-
tained by the School District. The staff recommended approval with certain con-
ditions. It was moved by Commissioner Antonini, seconded by Commissioner Johnston,
and carried, that the public hearing be closed. After further discussion, upon
motion of Commissioner Rega, seconded by Commissioner Johnston, the following
resolution was adopted by unanimous vote.
RESOLUTION N0. 499
WHEREAS, the application of the Pleasanton Joint School District,
1331 Santa Rita Road, for a Variance from Sections 6.500
and 18.603, Ordinance No. 309, in order to allow con-
struction of a fence along the Kolln Street frontage of
the Alisal Elementary School, in an R-1 District, has
come before this Commission:
NOW, THEREFORE, BE IT
RESOLVED, that the above-named application for Variance be approved
with the following conditions:
1. Land necessary for the street improvements
must be dedicated to the City and the im-
provements installed.
2. A four foot public service easement should be
dedicated to the City between the property line
and the proposed fence.
3.
