Chairman Landon opened the public hearing on the application of Shell 011 Company,
<br />315 Derby Avenue, Oakland, for a Variance from Section 12.500, Ordinance No. 309,
<br />in order to allow construction of an automobile service station with a reduced front,
<br />side and rear yard setback, located at the southeast corner of First Street and
<br />Vineyard Avenue, in a C-T District. Mr. Fales presented the staff report which
<br />pointed out that the applicant desired a Variance in order to construct a pump
<br />island, canopy and service station building partially within the required set-back
<br />lines. The staff felt that some of the conditions requiring the Variances did not,
<br />in fact, exist on the effective date of the ordinance, but were in fact, created by
<br />this proposed development. It was further felt that there were possibilities of
<br />additional property acquisition or re-orientation of the proposed building and
<br />pump island, that would alieviate the necessity for the requested variances. It
<br />was felt that limited variances could be granted on 'this property on the basis of
<br />a well thought out and designed site plan. Air. Dan Crietopolous of Shell Oil
<br />Company, displayed a scale model of the proposed station and pump island. Mr.
<br />Douglas Safreno, also present in the audience, spoke explaining the property Layout.
<br />The staff was questioned regarding the alignment of Ray Street and widening to First
<br />Street, and what plans have been made to carry out this proposal. Mr. Falea in-
<br />dicated that at the present time there were not sufficient funds to complete the
<br />project. It was moved by Commissioner Antonini, seconded by Commissioner Plato,
<br />and carried, that the public hearing be closed. After further discussion by the
<br />Commission, and with the consent of the applicant, upon motion of Chairman Landon,
<br />seconded by Commissioner Plato, and carried, it was determined to continue the
<br />request for Variance and Conditional Use Permit to the meeting of January 26, 1966.
<br />Chairman Landon then opened the public hearing on the application of Pleasanton
<br />Joint School District, 1331 Santa Rita Road, for a Variance from Sections 6.500 and
<br />18.603, Ordinance No. 309, in order to allow construction of a fence along the
<br />Kolln Street frontage of the Alisal Elementary School, in an R-1 District. Mr.
<br />Fales presented the staff report which stated that the school proposed to put in
<br />a four foot high chain link fence with a planting area inside the fence. It is
<br />proposed to have this fence set back four feet from the back of the sidewalk, which
<br />in this case would also be four feet from the property line. This 1s in connection
<br />with the Alisal School, which faces on Santa Rita Road; the portion of the school
<br />property which is adjacent to Kolln Street is all playground. Fencing of the play-
<br />ground area is desirable. The proposal by the school would put more of the area
<br />into the playground where it would be usable and would also be more easily main-
<br />tained by the School District. The staff recommended approval with certain con-
<br />ditions. It was moved by Commissioner Antonini, seconded by Commissioner Johnston,
<br />and carried, that the public hearing be closed. After further discussion, upon
<br />motion of Commissioner Rega, seconded by Commissioner Johnston, the following
<br />resolution was adopted by unanimous vote.

<br />WHEREAS, the application of the Pleasanton Joint School District,
<br />1331 Santa Rita Road, for a Variance from Sections 6.500
<br />and 18.603, Ordinance No. 309, in order to allow con-
<br />struction of a fence along the Kolln Street frontage of
<br />the Alisal Elementary School, in an R-1 District, has
<br />come before this Commission:
<br />NOW, THEREFORE, BE IT
<br />RESOLVED, that the above-named application for Variance be approved
<br />with the following conditions:
<br />1. Land necessary for the street improvements
<br />must be dedicated to the City and the im-
<br />provements installed.
<br />2. A four foot public service easement should be
<br />dedicated to the City between the property line
<br />and the proposed fence.
<br />3. The fences on the side shall be extended to match
<br />the existing proposed fence.
<br />4. Street trees shall be planted in the four foot
<br />easement in addition to the plantings shown.
