M. <br />Sc. Z-67-25. Wallace H. Maven. <br />The next item on the agenda was the application of Wallace H. Mayer, 4763 Black <br />Avenue for a Zoning Permit to conduct a professional office (public accountant) <br />in the home at the above address in an R-1 District. Mr. Spink presented the <br />staff report which recoammended approval. Mr. Mayer was present in the audience. <br />Also Mr. J. Corley, representing Mr. Mayer, was present and concurred with the <br />staff report. After further diacusaion, UPON MOTION OF COBIl~lISSIONSR JOHNSTON, <br />SECONDED BY COMMISSIONER ARNOLD, AND CARRIED, IT WAS DETERMINED THAT THE ABOVE <br />APPLICATION BE APPROVED. <br />4h. RZ-67-4. Volk McLain Communities. Inc. <br />Chairman Antonini opened the public hearing on the application of Volk McLain <br />Communities, Inc., 7727 Amador Valley Boulevard, Dublin, for an amendment to <br />Ordinance No. 309, pursuant to the provision of Sections 65854 and 65859 of the <br />Government Code, State of California, establishing zoning prior to annexation <br />for property generally bounded by Arroyo Mocho Canal, liopyard Road, Interstate <br />680, and the southerly boundary of the U.S. Army (Camp Parks) sewage treatment <br />ponds, from R-1-B-5 and C-N Alameda County zoning, to R-1 and C-N or other <br />districts, City of Pleasanton Zoning. Mr. Spink presented the staff report <br />which recommended that the Planning CommiBaion recommend to the City Council an <br />amendment to Ordinance No. 309, rezoning the subject property from R-1-B-5 and <br />C-N to R-1 and A in accordance with Exhibit "A". Mr. Ken Volk was present in <br />the audience together with Mr. Don Hoffman and Jack Brooks. Mr. Volk indicated <br />he did not feel that the areas designated to be held in the "A" zone were neces- <br />sary; that these areas should be rezoned at this time to allow C-N zoning. <br />Mr. Volk went on to state that they have demonstrated in the past their intent <br />relative to C-N areas by providing the facilities as needed. Mr. Volk went on to <br />state that it was difficult to talk about zoning without going into complete <br />development plans and that these plans were started in April of last year <br />and have gone through several revisions. The density and uses are less than <br />the uses in the original plan submitted. In October they submitted first maps to <br />the Subdivision Co®ittee and several revisions have resulted. In January, an <br />uninhabited annexation was filed and they again revised maps to include parks, <br />etc., that had come along. Then the Assessment District for sewer to Santa <br />Rita Road, affecting but not serving this property, and here they revised <br />again. They would like to develop as they have submitted. In rezoning they <br />would like to have a C-N Center and would agree to deed restrictions if City <br />desires on C-N areas or institutional areas. It was indicated that the insti- <br />tutional areas probably would be medical, lodge hall, church, which would be <br />acceptable to them; with the exception of the gas station which they want, in <br />order to allow a gas station on both sides of the street. Also, they have <br />two school sites included. It was stated that they did not know what is cus- <br />tomety to show good faith that one will develop as stated. Gulf, P-%, and <br />Shell have indicated an interest in this property. Mr. Volk also stated that <br />he felt that the City has done a good job with gas stations relative to archi- <br />tecture as well as the General Plan. <br />Mr. Volk further stated that he is sincere in developing property in the manner <br />which they have been discussing. If desired, there could be deed restrictions to <br />insure that markets, etc., would not go into the institutional area. There was <br />no objection to the "A" zoning on the area designated for institutional use; <br />and that both gas stations were aware of each other being located on the desig- <br />nated comers. At this point, Mr. Spink read letters of declaration of intent <br />from P & % Markets, Gulf 011 Company, and Shell Oil Company. However, it was <br />pointed out that these letters are not a guarantee nor a lease and that a determi- <br />nation should be made as to whether or not these Letters are adequate evidence. <br />Mr. Volk pointed out that not always can you get lease negotiations unless <br />you are ready to sign on the dotted Has, and that it is hard to sign a lease or <br />give option until you lay it out; and also that there is a lot of money involved <br />5-17-67 <br />
