Mrs Edgar presented the staff report which <br />recommended approval. Upon motion of Chairman Antonini, seconded by Commissioner <br />Garrigan, and carried, the public hearing was closed. Upon motion of Commissioner <br />Garrigan, seconded by Commissioner Plato the following resolution was adopted <br />by unanimous vote: <br />RESOLUTION N0. 707 <br />WHEREAS, the application of D & V Builders, 6000 Telegraph Ave- <br />nue, Oakland, for Variances V-67-31 through V-67-38 <br />and V-67-40 and V-67-41 for encroachments of a 6 foot <br />fence into the required aide street side yard at <br />the following addresses respectively: 2411 Crestline <br />and 2302 Sandpiper Way; 2327 Sandpiper Way and 2373 <br />Sandpiper Way; 2303 Sandpiper Way and 2397 Sandpiper <br />Way; 2303 Woodthrush Way and 2370 Raven Road; 2396 <br />Woodthrush Way and 2300 i+)oodthruah Way; 2372 Wood- <br />thruah Way: end 2324 iloodthrush Way; 4893 Canary Drive <br />and 2331 Willet Way; 2315 Raven Road and 2302 Willet <br />Way; 2009 Faven Road; 4714 Canary Drive have come <br />before this Commission, <br />NOW, THEREFORE, BE IT <br />RESOLVED: That the above named applications be approved. <br />Commissioner Plato indicated that he would like to point out the need in the new <br />Zoning Ordinance for a provision to cover this type of variance in an effort to <br />eliminate Chia type of variance from bhe.Commiasion agenda, and retain sane at a <br />staff level. <br />4m. V-67-39, Diamond Signs. <br />Chairman Antonini opened the public hearing on the application of Diamond Signs, <br />225 Post St., San Jose, for Permabilt Homes for a Variance from Sec. 17.705.1, <br />Ordinance No. 309 for two off-tract signs with area in excess of the maximum <br />Ordinance allowance. After discussion, upon motion of Commissioner Garrigan, <br />seconded by Chairman Antonini, and carried, the public hearing was closed. <br />Upon motion of Chairman Antonini, seconded by Commissioner Garrigan, the following <br />resolution was adopted by unanimous vote: <br />RE30LUTION NO. 708 <br />WHEREAS, the application of Diamond Signs, Inc., 225 Poat St., <br />San Jose, for Permabilt Homes Inc., for a Variance <br />from Sec. 17.705.1, Ordinance No. 309 for two off- <br />tract signs with area in excess of the maximum Ordi- <br />nance allowance to be located at Valley Avenue and <br />Hopyard Road in an "A" District and at Foothill Road <br />and Bernal Avenue in a "C-N" District has come before <br />this Commission, <br />NOW, THEREFORE, BE IT <br />RESOLVED: that the above named application be approved with the <br />following condition: <br />1. Approval shall be for a period of one year or for <br />six months after the new Zoning Ordinance is <br />adopted, whichever is leas. <br />Sa. Z-67-46, Milt & Julia Dunham. <br />Next on the agenda was the application of J. Jack Bras for Milt Dunham, 122 W~!st <br />Neal, for a Zoning Permit with Site Plan Approval for a proposed kitchen addition <br />and exterior remodeling of the street frontage at the above address in a C-C <br />District.
