Mr. Castro explained <br />to the Commission that certain leases now pending on the existing structures <br />should be reviewed by the Planning Commission. Mr. Plato expressed his con- <br />cern over improvements requiring curb replacement and change of curb radius <br />as recommended by the Public Works Department, further how these improvements <br />would be affected by the Del Valle Parkway. Mr. Campbell reminded the Commission <br />that the construction of the Del Valle Parkway was 10 to 15 years in the future. <br />There was considerable discussion about adequate parking. It was noted that <br />with the removal of two of the buildings in the rear, additional parking spaces <br />would be available. In reference to the proposed cedar shake roof, Mr. Castro <br />stated that the Commission could request the City Council to grant a Variance <br />to the Building Code, rather than a Code amendment, to allow said roof in <br />the area in question. Mr. Castro endorsed the shake roof for the proposed <br />service station, and stated he would like to see wood shakes used occasionally <br />1n the commercial districts where advisable. He suggested that the Commission <br />discuss the matter and if they approve, forward the recommendation to the <br />Council with a suggested alternate, in case a variance to Building Code is not <br />approved by the City Council. Upon motion of Chairman Antonini, seconded by <br />Commissioner Carrigan, and carried, the public hearing was closed. Upon motion <br />of Commissioner Arnold, seconded by Commissioner Plato, the following Resolu- <br />tion was adopted by unanimous vote: <br />RESOLUTION N0. 759 <br />WHEREAS, the application of the Union Oil Company, P.O. Box <br />940, San Jose, for a Variance to Section 12.500 to <br />permit the encroachment of the Trademark Sign 21 <br />feet into the required front yard setback; area <br />lighters 21 feet, 22 feet and 24 feet into the <br />required front yard setback; pump island 12 feet <br />into the required front yard setback; at the south- <br />east corner of Santa Rita Road and Stanley Boulevard <br />has come before this Commission, <br />NOW, THEREFORE, BE IT <br />RESOLVED: that the above application be approved for a <br />Variance (V-67-54) subject to the following <br />conditions: <br />1. That developer grant to the City, prior to issu- <br />ance of a building permit, the 9 foot widening <br />all along the Santa Rita Road frontage with a 30 <br />foot property line radius at Stanley Boulevard. <br />2. That street improvements including, but not <br />limited to curb and gutter, sidewalk, tie-in paving, <br />street trees and drainage structures, be constructed <br />along the total Stanley Boulevard frontage and <br />along the Santa Rita. Road frontage from Stanley <br />Boulevard to the future radius point of the Del <br />Valle Parkway. <br />3. That street improvements including but not <br />limited to sidewalk, tie-in paving and asphalt <br />berm be constructed across the Santa Rita Road <br />frontage from the future radius point of the <br />Del Valle Parkway to the existing improvements <br />of Vervain Street. <br />4. That the existing fire hydrant be replaced <br />with a new Greenburg ~~76 hydrant at a location <br />approved by the City and in accordance with <br />current City standards. <br />5. That the Trademark Sign may encroach 21 feet <br />into the required front yard setback. <br />G. That the Area Lighters may encroach 21, 22, <br />and 24 feet into the required front yard setback. <br />7. That the Pump Island may encroach 12 feet <br />into the required front yard setback. <br />
