<br />8.) Tract 2896 Stoneson Development Corporation.
<br />Request for Tentative Map Approval of Tract 2896, for 400± acres, located
<br />generally between Highway 680 and Foothill Boulevard and south of Highway 580.
<br />Mr. Castro recommended that the matter be continued to the meeting of April
<br />10, 1968, pending further study of the development by the Subdivision Com-
<br />mittee. Mr. Fales expressed his concern that if the map were continued,
<br />and in the mean time expired, the matter would be terminated. It was questioned
<br />whether 2896 was a new map or if part of it had expired. Alan Campbell explained
<br />that the upper portion of Tract 2896 had expired in February, and the lower
<br />portion, actually Tract 2843, would expire March 28, 1968. Mr. Fairfield
<br />stated the Planning Department should have received a request for a time ex-
<br />tension on the entire map. Mr. Struthers explained that if a map-.were
<br />partially acted upon, and then it expired, it could still be acted on. Mr.
<br />Struthers suggested that to clarify matters, a new map and ttum$et':'asar'e`. needed,
<br />with a routine consideration. After further discussion, UPON MOTION OF COM-
<br />MISSIONER GIBBS, SECONDED BY COPIMISSIONER ARNOLD, AND CARRIED, IT WAS DETERMINED
<br />TO CONTINUE THE MATTER OF THE TENTATIVE MAP 2896 TO THE MEETING OF APRIL 10,
<br />1968.
<br />(b.) Tentative Tract 2904, D & V Builders.
<br />Request of D ~ V Builders, 6000 Telegraph Avenue, Oakland, for a time extension
<br />of-Tract 2904. Mr. Castro informed the Co®ission that on February 28, 1968,
<br />a request for a time extension was made by D ~ V Builders and that after review,
<br />the Commission denied the extension pending certain street modifications.
<br />Mr. Castro further advised the Commission that the request today was legal and
<br />that the Commission could recommend the extension subject to certain conditions
<br />or could recommend denial. Mr. Castro further advised the Commission what
<br />effects the new Ordinance would have on the tentative map should an extension
<br />not be granted. Dudley Frost requested that the Commission recommend to the
<br />City Council a continuation of the time extension for Tract 2904, and that under
<br />the hardship policy allowed by the City Council for existing tentative maps,
<br />that the tract be 'governed by by Zoning Ordinance 309. Mr. Fates stated his
<br />interpretation of the Council's policy stated in Resolution 68-46, adopted
<br />March 25, 1968, was that existing tentative, final maps, and planned unit
<br />developments would have to comply with Ordinance No. 309. Upon motion
<br />of Commissioner Arnold, seconded by Commissioner Plato, the followinr,Resolution
<br />was adopted by unanimous vote:

<br />on Tentative Tract Map 2904 has come before this
<br />Commission,
<br />NOW, THEREFORE, BE IT
<br />RESOLVED: that the Planning Commission does hereby recommend
<br />to the City Council that a time extension of one year
<br />be granted for Tentative Map 2904, subject to the
<br />following condition:
<br />1. That the proposed street pattern shall be
<br />revised as per Exhibit "A", dated March 11,
<br />1968.

<br />Application of Louis B. Miller, 871 Kottinger Drive, for a Variance (V-68-4;
<br />to allow the construction of a swimming pool to encroach 1 foot into the required
<br />rear yard setback for an accessory use. The applicant was present and complied
<br />~>,ith the suggested condition. Upcn motion of Chairman Antonini, seconded '
