Upon motion of Commissioner Garrigan, seconded by Commissioner Plato, the <br />following Resolution was adopted by unanimous vote: <br />RESOLUTION N0. 774 <br />WHEREAS, the application of Kaiser Sand 6 Gravel, 300 Lake- <br />side Drive, Oakland, for a Variance V-68-5 to. Section <br />15.400 to allow the construction of an aggregate <br />plant to exceed the height limitation of 50 feet <br />as shown on the construction plans, filed at 603 <br />Main Street, in an I-G District (General Industrial) <br />has come before this Commission, <br />NOW, THEREFORE, BE IT <br />RESOLVED: that the above application be approved with the <br />following conditions: <br />1, that construction of the aggregate plant be <br />allowed to exceed the height limitation of 50 <br />feet as shown on the construction plane. <br />2. That the permit is granted for the land as <br />described in the application and any attachment <br />thereto and as shown on the plot plan and ele- <br />vation plan submitted labelled Exhibit A. <br />6c.) Z-68-19i Kaiser Sand and Gravel Comvanv. <br />UPON MOTION OF COMMISSIONER GARRIGAN, SECONDED BY COMMISSIONER PLATO, AND <br />CARRIED, IT WAS DETERMINED TO APPROVE ZONING PERMIT Z-68-19 AS STATED ABOVE <br />SUBJECT TO THE FOLLOWING CONDITIONS: <br />1. That all roads or hauling routes located within the area encompassed by <br />this permit shall be oiled or otherwise treated as necessary to prevent the <br />emanation of dust. <br />2. That the rules and regulations of the Bay Area Air Pollution Control <br />District, as amended and all subsequent amendments which are filed in the <br />office of the Board of Directors are hereby adopted by reference and made part <br />hereof. For the general rules controlling air pollution causes, by or arising <br />out of the operation and use or uses for which this permit is granted, said <br />rules and regulations shall apply, but such rules and regulations shall not <br />modify or replace any specific regulations stated herein. For the purpose of <br />enforcement within the limits of the land for which this permit is granted, <br />the "Air Pollution Control Officer" referred to in said rules of the Bay Area <br />Air Pollution Control District shall mean the control officer of the Bay Area <br />Air Pollution Control District, and the granting of the permit shall be consid- <br />ered as the equivalent of the application, hearing, and permit required in <br />said rules. Methods and costa of analysis and reports and prohibitions and <br />general conditions shall be as provided in said rules. <br />3. That the person, firm or corporation responsible for the operation and use, <br />for uses for which this permit is issued shall cause teats to be made at the <br />direction of the Control Officer or the City's Planning Director for the pur- <br />pose of obtaining samples of discharge from stacks or other points of admission <br />or samples of the air in the vicinity of land for which this permit is issued <br />to determine the content and amount of gaseous substances, dust, smoke, or other <br />emissions being discharged into the atmosphere. The time of making such tests <br />and the number and character of testa to be made shall be as directed by the <br />Control Officer or the City's Planning Director, who shall also approve the <br />person or agency making such test or sampling. All cost of taking said samples <br />or making such tests and the analysis thereof and report thereon shall be borne <br />by the person, firm, or corporation above mentioned. <br />Sb.) UP-68-4, Donald Siliso. <br />Chairman Antonini opened the public hearing on the application of Donald Siligo, <br />1000 Marin Street, San Francisco, for a Conditional Use Permit under Section <br />14.400a to allow the operation of a commercial nursery at 5511 Sunol Boulevard <br />in an I-P District. Mr. Castro referred to the staff report and recommended <br />denial of the request for various reasons, mainly because the use was not <br />appropriate in an I-P District. Mr. Miller, a real estate agent for the appli- <br />cant, stated the property would be developed and maintained by the owner. Re- <br />garding Mr. Castro's objection, sa stated in the report, to traffic congestion, <br />Mr. Miller felt the nursery would generate very little traffic compared to the <br />2, 4-24-68 <br />
