proposed shopping center to be located on Sunol Boulevard. Mr. Miller indi- <br />cated the applicant would be agreeable to a Conditional Use Permit for a <br />limited time. Mr. Clarence Gribbin, real estate broker, noted that Sunol <br />Boulevard would be widened eventually, thus easing the traffic problem. Mr. <br />Gribbin indicated that though the nursery was not similar in use to the existing <br />type of developments, its location would be cleser to town than to the Kaiser <br />Plant. Mr. Gribbin continued that the property in the past has not been mar- <br />ketable for other than the proposed type of use. Mr. Gribbin stated about <br />$26,000 would be invested for capital improvements initially, most of which <br />would be retained in the upgrading of the property. About 6 months, he <br />continued, would be required to accommodate the nursery for operation. Mr. <br />castro repeated his thought that the proposed use was not in keeping with the <br />type of facilities presently located in the area; also that new industry <br />interested in the immediate area would be discouraged if such conditional uses <br />are allowed. Upon motion of Chairman Antonini, seconded by Commissioner Arnold, <br />and carried, the public hearing was closed. Zt was noted that a. rezoning pro- <br />cess would be needed under the new Zoning Ordinance for this use, as it does <br />not allow conditional use permits in the I-P District. Commissioner Plato <br />felt the access road should be improved, allowing more parking. UPON MOTION <br />OF COMMISSIONER GARRIGAN, SECONDED BY COMMISSIONER PLATO, AND CARRIED, THE <br />APPLICATION UP-68-4 WAS CONTINUED TO THE NEXT REGULAR MEETING OF MAY 8, 1968, <br />WITH THE APPLICANT'S CONSENT, TO ALLOW STAFF TO PREPARE CONDITIONS ON ROAD <br />IMPROVEMENTS. <br />Sc.) V-68-6, Fremont Savings and Loan <br />Chairman Antonini opened the public hearing on the application of Edward M. <br />Devan, 41585 Covington Drive, Fremont, for a Variance to Section 8.500 to <br />allow the construction of a 7 unit apartment building to encroach 5 feet <br />into the required front yard setback; said property commonly known as 4801 <br />Harrison Avenue. Mr. Castro stated the plan had been revised considerably <br />since the first submittal; indicating the reason for the Variance encroachment <br />into the front yard setback was to allow more width in the one bedroom unit. <br />Mr. Castro indicated that some conditions on the first unit which were not <br />met have been placed on the proposed unit, including the requirement for street <br />trees. Both units are owned by Fremont Savings and Loan, Mr. Castro noted. <br />Upon motion of Chairman Antonini, seconded by Commissioner Garrigan, the <br />public hearing was closed. The Commission expressed concern that the land- <br />scaping would not be maintained, and that possibly developments should be <br />conditioned to maintain landscaping. Upon motion of Commissioner Garrigan, <br />seconded by Ghairman Antonini, the following Resolution was adopted by unani- <br />mous vote: <br />RESOLUTION N0. 775 <br />WHEREAS, the application of Edward M. Z-68-15, Fremont Savings & Loan. <br />It was decided to also consider Zoning Permit Z-68-15 at the same time, appli- <br />cation of Fremont Savings and Loan, 40587 Fremont Boulevard, Fremont, for <br />a Zoning Permit with Site Plan, Architectural and Landscape Approval to con- <br />struct a seven unit apartment building at 4801 Harrison Avenue. After further <br />discussion, UPOIdt40TI0N OF COMNIISSIONER GARRIGAN, SECONDED BY CHAIRMAN ANTONINI, <br />AND CARRIED, IT WAS DETERMINED TO APPROVE ZONING PERMIT Z-68-15 SUBJECT TO <br />THE FOLLOWING CONDITIONS: <br />1.
