b. RZ-68-10, Lee J. Amaral
To rezone that property as described in Map Book 946, Block 1250, Parcel 8-1
containing more or less 12 acres or commonly known as that property adjacent
to and east of the Berry Farm on Stanley Boulevard from an Agricultural (A)
District to a Service Commercial (C-S) District.
Chairman Antonini opened the Public Hearing. Planning Director Castro took
time to read the entire staff report, as he felt it important that the points
as stated in the report were clarified to the Commission.
Since the area is zoned primarily as Freeway Commercial, with only the one
portion of said application marked as (A) Agricultural to the northeast, it
would be in line for the Planning Commission to consider the application of
Mr. Amaral at this time. Mrs. Amaral was at the meeting and offered a new
plot plan. This new plan showed the first phase of the proposed building
with dimensions of 50 ft. X 40 ft., with parking in the interior of the
property.
Commissioner Plato expressed concern over the Commission being able to
control this use for the small auto assembly plant without having this
operation eventually take over the entire site. Mrs. Amaral stated that a
large auto parts assembly was not probable, as the need for just a small
parts assembly came about as a direct result of the need for this type of
operation. Planning Director Castro concurred and stated that the Planning
Commission had the authority to condition the assembly operation at the time
the Zoning Permit application comes in. The rest of the building is planned
for small contractors', either plumbing or electrical or related uses
businesses and with this type of occupancy in the rest of the building,
there should be no problem for the Planning Commission to approve the small
portion of the building for the auto assembly plant.
Upon motion of Chairman Antonini, seconded by Commissioner Arnold, and
carried, the Public Hearing was closed.
UPON MOTION OF COMMISSIONER PLATO, SECONDED BY COMMISSIONER ARNOLD, AND
CARRIED, THE FOLLOWING RESOLUTION WAS ADOPTED.
RESOLUTION N0. 822
A resolution of the Planning Commission
of the City of Pleasanton recommending
to the City Council the granting of
Zone Amendment No. RZ-68-10, filed by
Lee J. Amaral.
WHEREAS, the Planning Commission of the City of
Pleasanton has considered Zone Amendment
Petition No. RZ-68-10 filed by Lee J.
Amaral to amend Zoning Ordinance No. 520
by rezoning a portion of Map Book 946,
Block 1250, Parcel 8-1, containing more
or less 1'~ acres or commonly known as
that property adjacent to and east of
the Berry Farm on Stanley Boulevard.
WHEREAS, said Commission has held a Public Hearing
on this Petition and has examined the
Pertinent maps, drawings and documents and
finds that the following conditions do exist:
1. That the proposed amendment will not be
contrary to the spirit and intent of the
General Plan.
2. That the proposed amendment is in the
public interest and general welfare.
3. That the proposed amendment creates a
more equitable condition for the community
than now prevails.
- 3 -
_ ., . ,
