Resolution No. 2829 <br />Planning Commission <br />September 10, 1986 <br />c. fencing along the pathway shall meet City <br />requirements for fences abutting public <br />property, the final design to be approved by <br />the Planning Director prior to approval of the <br />final map; and <br />d. the existing fence along the southerly <br />boundary may be retained. <br />7. That the developer shall grant view easements, <br />satisfactory to the City Attorney, to the owners of <br />Lots 46 and 47 of Tract 4611, to run with the land, <br />establishing a view easement over Lots 3 through 8 <br />which bars obstructions into a view corridor at an <br />elevation five (5) feet above their residences' <br />respective finished floor elevations. <br />8. That the mass grading shall be subject to the <br />following: <br />a. a dust control plan, satisfactory to the City <br />Engineer, shall be prepared and followed; <br />b. That grading operations shall be limited to <br />weekdays only between the hours of 8:00 a.m. <br />and 6:00 p.m.; <br />c. That no grading operations shall occur unless <br />the winds are calm or from the west; <br />d. That no stockpiling of topsoil or other <br />material shall occur on-site unless measures <br />satisfactory to the City Engineer to control <br />dust are included; <br />e. That notice shall be given to all neighbors at <br />least three days prior to the start of grading <br />operations; and <br />f. That the developer establish a haul route, <br />approved by the Planning Department, prior to <br />the issuance of a grading permit, said route <br />shall minimize disturbance to existing <br />neighbors. <br />9. That in the event the excess dirt material cannot <br />be off-hauled across the Pleasanton School District <br />property for deposition on the Lund Ranch property <br />or on the School District property, this <br />development plan shall be null and void unless an <br />alternative fill site and haul route satisfactory <br />to the Planning Director can be found. The haul <br />route shall not be across improved public <br />rights-of-way for quantities in excess of 10,000 <br />cubic yards of material. <br />- 3 - <br />
