Resolution No. 2829 Planning Commission September 10, 1986 c. fencing along the pathway shall meet City requirements for fences abutting public property, the final design to be approved by the Planning Director prior to approval of the final map; and d. the existing fence along the southerly boundary may be retained. 7. That the developer shall grant view easements, satisfactory to the City Attorney, to the owners of Lots 46 and 47 of Tract 4611, to run with the land, establishing a view easement over Lots 3 through 8 which bars obstructions into a view corridor at an elevation five (5) feet above their residences' respective finished floor elevations. 8. That the mass grading shall be subject to the following: a. a dust control plan, satisfactory to the City Engineer, shall be prepared and followed; b. That grading operations shall be limited to weekdays only between the hours of 8:00 a.m. and 6:00 p.m.; c. That no grading operations shall occur unless the winds are calm or from the west; d. That no stockpiling of topsoil or other material shall occur on-site unless measures satisfactory to the City Engineer to control dust are included; e. That notice shall be given to all neighbors at least three days prior to the start of grading operations; and f. That the developer establish a haul route, approved by the Planning Department, prior to the issuance of a grading permit, said route shall minimize disturbance to existing neighbors. 9. That in the event the excess dirt material cannot be off-hauled across the Pleasanton School District property for deposition on the Lund Ranch property or on the School District property, this development plan shall be null and void unless an alternative fill site and haul route satisfactory to the Planning Director can be found. The haul route shall not be across improved public rights-of-way for quantities in excess of 10,000 cubic yards of material. - 3 -
