STREET SWEEPING AGREEMENT THIS AGREEMENT is made and entered into this day of September, .1989, by and between THE CITY OF PLEASANTON, a municipal corporation (the "City") and A-1 ENTERPRISES, an unincorporated association (the "Contractor"). WHEREAS, the Contractor has represented that it is qualified to perform and capable of performing street sweeping services within the City of Pleasanton; and WHEREAS, the City desires to improve its existing street sweeping service level and to provide the street sweeping service in the most efficient and cost effective manner; and WHEREAS, the City wishes to contract with the Contractor for such services; NOW, THEREFORE, the parties hereto agree as follows: 1. Contractor's Services. The Contractor shall faithfully and regularly undertake street sweeping services as described in this Agreement. 2. Street Sweepinq Services - Categories of Areas to be Swept. a. Existing City Streets. City streets to be swept as of the date of execution of this Agreement are shown on the attached Exhibit A. (1) For purposes of calculating payment for street sweeping, it is assumed that the total length of curb miles contained in those streets shown on Exhibit A is 577 miles. "Curb miles" shall be the miles of each curb (or edge of pavement where no curb exists) of the City street, including median curbs and "buttoned medians" for those streets required to be swept along medians as well as edges of pavement. The Contractor shall have sixty (60) days from the execution of this Agreement to verify the estimated curb miles of the streets shown on Exhibit A. The Contractor or the City may ask for an adjustment to the contract price if the actual curb miles, as verified by the Contractor and agreed to by the Director of Public Works (the "Director") exceeds by five percent (5%) of the total estimated mileages of 577 miles or a verified curb mileage total of 577 miles.
