Alameda County Waste Management Authority <br />Resolution No. 33 - July 19, 1989 <br />Page 4. <br /> <br /> The Zoning'Aamiaistrator shall confirm that said Schedule provides for <br /> a program to designate a landfill site(s) in the Contra Costa County <br /> General Plan and Solid Waste Management Plan, a program to issue a CUP <br /> for the lanch~ill, acquire other necessary permits ann establish an <br /> operating landfill~ The program must provide landfill capacity in <br /> Contra Costa County to meet the projected MSW needs of Contra Costa <br /> for a minimum of 20 years. <br /> <br /> The program must specify that the County Solid Waste Management Plan <br /> provide for reciprocal use of the new landfill(s) to uispose MSW <br /> generated in Alameda County, based on equivalent tonnage as would be <br /> imported into Alameda County during the proposed ~wo-year import <br /> period. Reciprocal capacity shall be provided by Contra Costa County <br /> at a price not to exceed ~he disposal cost at the Al~amont Landfill as <br /> inflated by Exhibit B of the Mitigated Negative Declaration provisions <br /> or resulting from mandated costs attributed to changes in Federal or <br /> State regulations. This capacity shall be guaranteed in whatever <br /> landfill is finally approved and developed in Contra Cos~a County. <br /> This capacity shall be guaranteed to the Alameda County Waste Manage- <br /> ment Authority and its member agencies upon reasonable noitice of its <br /> need and without conditions. The guarantee shall be in the form of a <br /> binding agreement between the County of Conira Costa and the Alameua <br /> County Waste Management Authority. The Authority considers that, due <br /> to the long hauling distances to the future landfill(s) in ConEra <br /> Costa County, the reciprocal capacity provided for herein is expected <br /> to be used by Alameda County jurisdictions on an emergency basis ate <br /> Goes no= mitigate the loss of landfill capacity in Alameda County that <br /> would result from the proposed importation of Contra Costa MSW. <br /> <br /> The Schedule and program shall be at least as restrictive and <br /> comprehensive as the Solid Waste Disposal Facility Implementation <br /> Schedule and Landfill Plans and Projects Processing Timetables <br /> included in ~he March 2s 1989 Peremptory Writ of ManGate issued by <br /> the Con=ra Costa County Superior Court. Before OSC may accept any <br /> Contra Costa County MSW, OSC shall also provide evidence to the Zoning <br /> Aam~-]s=rator of a financial commitment on the part of Conira Costa <br /> County and a majority of its cities containing a majority of the <br /> incorporated population to implement the scheduled program including <br /> anticipated environmental reviews. <br /> <br /> Said Schedule must be approved by resolution of the Alameda County <br /> Waste ~anagemen= Authority before submittal by OSC to the County <br /> Zoning Administrator. <br /> <br /> At six month intervals subsequent to the date of the start of import, <br /> OSC shall report to the Zoning Administrator on the progress made by <br /> Contra Costa County, its cities and the landfill owners/operators in <br /> that county in meeting the implementation schedule to establish a <br /> landfill in that county.
