Current Legislative Activity At the present time, Congress is in recess for the 4th of July holiday. Just prior to recess, however, the Senate Finance Committee published it's report on the Child Care and Health Insurance Act of 1989. This report reflects the intent of the Senate to remove from the qualification requirements certain fringe benefits: employee discounts, no-additional-cost services, and employer provided eating facilities. The Act also would delay, generally, the effective date of the qualification roles from October 1, 1989 to January 1, 1990. A comparable bill in the House is also currently in Committee. We expect that both Houses will give priority to these bills after the holiday. I have attached excerpts from the Senate Report as Exhibit A. Services to be Provided We are prepared to review all benefit plan documentation in light of current legislation~ and provide you with our opinion relating to the City's compliance. In the event of new legislation, we will be prepared to modify the opinion accordingly as a pan of this engagement. The actual tasks involved include the following: * Review documentation of plans for satisfaction of requirements. * Recommend changes and/or additions to existing documentation. * Review and comment on the City's procedures for dissemination of plan information. * Review each plan for satisfaction of the permanency requirements. * Review non-employee participation in plans for violation of requirements. * Review plans for evidence of practice of "administrative exceptions" and provisions applicable at the City's discretion. * Provide a draft wrap-around document. * Provide a wriuen opinion relating to the City's compliance with current law.
