Current Legislative Activity <br /> <br />At the present time, Congress is in recess for the 4th of July holiday. Just prior to recess, <br />however, the Senate Finance Committee published it's report on the Child Care and Health <br />Insurance Act of 1989. This report reflects the intent of the Senate to remove from the <br />qualification requirements certain fringe benefits: employee discounts, no-additional-cost <br />services, and employer provided eating facilities. The Act also would delay, generally, the <br />effective date of the qualification roles from October 1, 1989 to January 1, 1990. A <br />comparable bill in the House is also currently in Committee. We expect that both Houses <br />will give priority to these bills after the holiday. I have attached excerpts from the Senate <br />Report as Exhibit A. <br /> <br /> Services to be Provided <br /> <br />We are prepared to review all benefit plan documentation in light of current legislation~ <br />and provide you with our opinion relating to the City's compliance. In the event of new <br />legislation, we will be prepared to modify the opinion accordingly as a pan of this <br />engagement. <br /> <br /> The actual tasks involved include the following: <br /> <br /> * Review documentation of plans for satisfaction of requirements. <br /> <br /> * Recommend changes and/or additions to existing documentation. <br /> <br /> * Review and comment on the City's procedures for dissemination of plan <br /> information. <br /> <br /> * Review each plan for satisfaction of the permanency requirements. <br /> <br /> * Review non-employee participation in plans for violation of requirements. <br /> <br /> * Review plans for evidence of practice of "administrative exceptions" and <br /> provisions applicable at the City's discretion. <br /> <br /> * Provide a draft wrap-around document. <br /> <br /> * Provide a wriuen opinion relating to the City's compliance with current law. <br /> <br /> <br />
