3. Property Owners with unimproved property which is accessed by the Road <br />shall pay no maintenance costs, until such time as such Property Owner <br />develops his or her property; and <br />4. Lessees or licensees shall pay to the City One Hundred Dollars ($100.00) <br />each for maintenance costs. <br />b. All additional funds needed to pay for maintenance costs shall be paid from the <br />funds of the Pleasanton Township County Water District Assessment District #3 <br />Fund. <br />V. ADMINISTRATION OF AGREEMENT AND ADMINISTRATIVE FEE <br />The City shall administer this Agreement and all contracts made pursuant to this <br />Agreement. The City shall charge its customary administrative fee of ten percent (10%) which <br />shall be paid from the funds of the Pleasanton Township County Water District Assessment <br />District #3 Fund. <br />VI. RESERVATION OF RIGHTS <br />a. Nothing in this Agreement shall be understood or construed to prevent the City of <br />Pleasanton, as the record owner of the Road, from undertaking on any part of the <br />Road or adjacent property, actions reasonably necessary to preserve its title to and <br />use of Road, in City's sole and absolute discretion. Nothing in this Agreement <br />shall affect the City's existing or future title to and use of the roadway, nor be <br />construed as granting Parties any property interest in Road, except as expressly <br />granted by the City. <br />Nothing in this Agreement shall affect the existing or future rights of the Property <br />Owners and Lessees to the use of the roadway. <br />VII. OBLIGATION TO REBUILD ROAD. <br />If all or any portion of the Road is damaged or destroyed by land slide or other casualty, <br />the City shall undertake the repair, rebuilding, or reconstruction of the road using funds from the <br />account of the Pleasanton Township County Water District Assessment District #3 Fund upon <br />approval by the City Council. <br />VIII. RIGHT OF ENTRY FOR REPAIRS AND ACCESS <br />Parties, their agents and employees will be permitted to travel on, cross, enter the Road at <br />any reasonable hour of the day to make or facilitate repairs on any part of the Road. In addition, <br />Parties shall have unrestricted use of the Road for access to and from their property. <br />Santos Ranch Road Maintenance Agreement 4 <br />
