III. RESPONSIBILITIES OF PARTIES <br />The Parties shall be responsible for the following: <br />a. The Parties shall exercise reasonable care in using the Road and gate. <br />b. The Parties shall use their best efforts to prevent injury or damage to the Road and <br />gate. <br />Any Party (for purposes of this subsection referred to as the "Responsible Party") <br />who causes damage to the Road, gate or storm drains shall, at Responsible Party's <br />sole expense, immediately repair the same within fourteen (14) days. If the <br />damage, or nuisance is caused by a family member, guest, agent, employee, or <br />subtenant of a Party, then said Party shall be the Responsible Party. <br />If the Responsible Party fails to act promptly, or should the exigencies of <br />the damage require repairs or replacement to be made before the <br />Responsible Party can be notified or can respond to the notifications, City <br />or any other Party to this Agreement may, at its option, make the <br />necessary repairs or replacement or perform the necessary work. Under <br />such circumstances. City or any such other Party shall provide <br />Responsible Party with notice of intent within three (3) business days of <br />performing such necessary work, and the responsible Party shall be <br />charged with all the reasonable expenses incurred in the performance of <br />the work. <br />2. If a Responsible Party cannot be determined, the cost of repairs shall be <br />added to the maintenance work set forth in Section I. <br />d. No Party may store, dump, or leave on, along, or adjacent to the Road or storm <br />drains any material, including but not limited to construction materials, debris, <br />soil, rocks, or plant material, unless previously approved by the City, local <br />ordinance, or other local agency approval. <br />IV. ALLOCATION OF COSTS <br />a. On July 1 of each year of this Agreement: <br />1. Property Owners who have a residence which is accessed by the Road <br />shall pay to the City One Hundred and Fifty Dollars ($150.00) per <br />residence for maintenance costs; <br />2. Property Owners who have non-residential improvements which are <br />accessed by the Road shall pay to the City One Hundred Dollars ($100.00) <br />for maintenance; <br />Santos Ranch Road Maintenance Agreement ~ <br />
