Date : May 11, 1971 Time : s:oo PM PIG C8; Pleasanton Justice Court Mr. Raphel indicated his willingness to cooperate with the City completely and said he would bring in a letter stating that Sing r Housing Company would not permit the service station to open for business until the completion of the construction on the Lucky Store. A resolution recommending approval of this conditional use permit subject to conditions noted in the staff reports, was entered and passed. Chairman Garrigan then noted that once again the Commission, although the applicant did not come right out and say it, did indicate the promise of a fine shopping center and anchor tenant. The Chairman noted that the Commission often is placed in an untenable position regardless of how they may vote. He wished to clarify that if the station had not come in tied in with the shopping center, he would not have voted for it. CONDITIONAL USE PERMIT Humble Oil ~ Refining Company - conditional Resolution: UP-71-10, Denied, use permit to allow the construction and Seconded: Res. 1087. operation of an Enco service station on the Ayes: southeasterly corner of Hopyard Road and Noes: Valley Avenue, in a C-N (Commercial Neighbor od) Absent: District, Pleasanton. Abstain: The Public Hearing was opened by Chairman Garrigan. Present to speak for Humble Oil was Mr. Joe Schwab, Attorney. Also present were Messrs. Mike Majors and Don Kallenberg of Humble Oil ~ Refining Company. Mr. Schwab clarified for the Commission that they too would be willing to present in writ ing an agreement that they will not permit their sta tion to open until the Alpha Beta market is constructed. - 3 -
