If Mr. Smith <br />reduced his proposed building by 320 <br />ft. , he would conform to the code, <br />but Mr. Baker would still be short <br />of four parking spaces. <br />The Public Hearing was opened. <br />Mr. Smith, the applicant, was pre- <br />sent and spoke to this case. He <br />indicated that he had a dilemma with <br />his parking situation, and that he <br />had exhausted all other means of <br />resolving the problem. Commissioner <br />Pereira wished to know whether Mr. <br />Smith would be receptive to parti- <br />cipating in a parking district for <br />the downtown. The applicant replied <br />that he would cooperate fully. <br />Next, the conditions of approval were <br />reviewed. Discussion ensued on Con- <br />dition No. 3, which pertained to the <br />requirement for an agreement regard- <br />ing a mutual non-exclusive easement <br />for ingress and egress to the sub- <br />ject property and other affected <br />properties, being filed with and <br />approved by the City Attorney. <br />Mr. Smith told the Commission that <br />he has an agreement in writing in <br />effect for 10 years, and this will <br />be turned over to the City for re- <br />cordation. Commissioner Pereira <br />indicated that this agreement should <br />be tied in with the properties in <br />question, rather than with the <br />property owners . <br />The Public Hearing was closed. <br />-5- <br />
