CITY of PLEASANTON
Plarvning Commission
MINUTE~R ~QF REGULAR MEETING.
Data Z October 10, 1973
Time ; 8 :45 P.M.
PtOQej Pleasanton Justice Court
would occur purely for reasons of
sale, lease or financing. Other
requirements would have to be met,
and these are spelled out in the
ordinance amendment adopted by
Council.
The reason why this amendment was bein
considered by the Commission that
evening is specifically tied in
with the application of C & H Develop
ment for a restaurant and motel to
be located off Hopyard Road in the ~I
vicinity of Denny 's Restaurant and
the Standard Oil station.
Because of possibility of losing
sewer capacity given to the developer
by Valley Community Services District
the City felt that it should take
advantage of a 1972 admendment to
Sec. 11535 of the Subdivision Map
Act relating to the waiver of filing
of a parcel map for land to be divide
solely for financial purposes. The
Planning Commission, under the amende
'ordinance, would make the determina-
tion whether a minor subdivision in
a given situation, would need to be !,
'filed or not.
The City has discussed the matter wit
the legal counsel for V.C.S.D., as
well as with C & H Development
Company, and this method of resolving
the situation was chosen. In addi-
tion, the revised language of the
ordinance was approved by V.C.S.D.'s
counsel.
Mr. Bill Hirst was present and told
the Commission that C & H Development
Co. stood to lose 50°s-75% of their
sewer priority from V.C.S.D., for
which the fee had already been paid.
-2-
~~~~\\
~~ ~~~~~~
~\ \\~
~~ \~`
~~~~~~,
t
I ~ t
~ r
i,
t i
Jai l
