M. <br />plaGa: Pleasanton Justice Court <br />Secretary Harris indicated no other <br />comments than those in the staff <br />report. <br />The Public Hearing was opened. <br />Neighbors of the Fosses, Captain <br />Chester, and his wife, 528 Hamilton, <br />spoke in opposition to this appli- <br />cation. <br />Originally the Fosses had a rooster, <br />which disturbed the neighborhood. <br />This rooster was disposed of and they <br />now have two Plymouth Rock Bantam <br />hens, which are the children's pets. <br />The Chesters felt that there would <br />be problems if this is allowed in a <br />residential neighborhood; also, they <br />indicated noise problems. <br />The Public Hearing was then closed. <br />A resolution was offered by Com- <br />missioner Wood, seconded by Com- <br />missioner McLain recommending appro- <br />val subject to staff conditions. <br />This resolution carried no votes <br />from Commissioners Carrigan, Pons <br />and Chairman Pereira, with only two <br />yes votes from Commissioners McLain <br />and Wood, thus not qualifying for <br />passage. <br />The Commissioners asked the City <br />Attorney, if it is determined, for <br />instance, as early as the following <br />week that the keeping of the two <br />chickens would constitute a nuisance, <br />how long would it take-through legal <br />means to abate the use. The City <br />Attorney indicated the situation <br />would fall in the category of dis- <br />turbing the peace and hearings would <br />-6- <br />
