Also, <br />if appeals are forthcoming, how <br />would the 90-day closure period <br />affect this particular case. <br />In addition, Commissioner Shepherd <br />requested that Mr. Greenberg once <br />again recount the occurrences lead- <br />ing up to the request of his client <br />for a conditional use permit. Dis- <br />cussion ensued regarding this phase. <br />The City Attorney explained staff's <br />position in this matter. <br />The Chairman stated that his picture <br />of the Central Business District did <br />not include "cut-rate" gas stations. <br />He did not feel that the decor of <br />the two plain pump islands added to <br />the heritage look. As far as re- <br />quirement for public health and <br />welfare in the City codes, perhaps <br />this station should not exist in its <br />present form and he did not feel <br />that the public welfare and safety <br />would be served by expanding this <br />gas station. He indicated that he <br />could not make the required findings. <br />Commissioner Butler asked Secretary <br />Harris to explain how the most <br />westerly pump island recommended by <br />staff on the revised plan would fit <br />in relation to the heritage tree, a <br />this was described for him. Com- <br />missioner Butler further expressed <br />the opinion that the revised plan, <br />combined with the conditions for <br />approval, did carry the potential <br />for alleviation of the. traffic pro- <br />-6- <br /> <br />
