He <br />felt that since the use is condi- <br />tional in any district, if the find- <br />ings can be made for the granting <br />of the conditional use permit, it <br />cannot be argued that such a use <br />should not exist in the district. <br />It was Commissioner Shepherd's posi- <br />tion that the applicant had adequate <br />notification from staff that a <br />conditional-use permit would be <br />required. Also, he was concerned <br />about the traffic and aesthetics of <br />the station., He felt he would be <br />equally unhappy with the operation <br />as it exists or with an expanded <br />one. <br />Commissioner Doherty stated that he <br />felt the property was purchased by <br />Mr. Graffenstatte in good faith. <br />~He is a strong believer in property <br />,rights. However, in this case, it <br />'must be taken into consideration <br />that the property lies in the central <br />district, plus there is the traffic <br />problem. Also, he was not certain <br />if by revising the site plan to <br />move the pumps westerly, that the <br />traffic situation could be alleviated <br />A resolution recommending denial., <br />subject to findings spelled out in <br />Resolution No. 1366, was entered and <br />adopted. Those findings were: <br />That it could not be established that <br />the operation of the conditional use <br />permit would not be detrimental to <br />the public health, safety or welfare <br />or materially injurious to property <br />in the vicinity, for the following <br />reasons: <br />-7- <br />
