Mr. Harris stated that it becomes difficult to make decisions before <br />development plans have been reviewed. Mr. Augusta stated he merely <br />wanted his requests put in the record so that they can be considered <br />in the future. Mr. Harris explained that the zoning is only one <br />half of a PUD application and that there isn't anything Mr. Madden <br />can do until he gets development plan approval. Mr. Augusta stated <br />that he opposes any building on the narrow strip and that with <br />regard to the back of the property line he would prefer a driveway <br />or parking area over buildings being placed along the fence when <br />the plan comes in. He spoke to concerns with the destruction of <br />trees if buildings are put in. He said hopefully members of the <br />Planning Commission or staff can add further modifications. <br />Chairperson Getty asked Mr. Augusta if he had any problems with the <br />uses proposed. <br />Mr. Augusta said, no, he does not. <br />Mr. Madden rebutted the statements made by Mr. Augusta reiterating <br />that he wants to have a minimum impact on the family life styles <br />surrounding his property. He said he doesn't care if the strip is <br />cut off. He said the planning staff suggested it be used for <br />emergency access. He said he proposes a buffer be made separating <br />the residential from the proposed commercial area. <br />The public hearing was closed. <br />A motion was made by Commissioner Lindsey, seconded by Commissioner <br />Doherty, that the negative declaration prepared for case PUD-81-35 <br />be recommended for adoption inasmuch as the prezoning would have no <br />significant impacts on the environment. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />Noes: None <br />Resolution No. 2121 was then entered and adopted recommending approval <br />of the negative declaration prepared for case PUD-81-35 as motioned. <br />Commissioner Wilson said he can see Mr. Augusta's points. If Mr. <br />Madden acquires the Southern Pacific right-of-way, it would be <br />considerably larger but this entire thing is far down the road. He <br />indicated that by ordinance the Planning Commission and City Council <br />would protect Mr. Augusta's property and that it is a matter of <br />record now that Joe Madden agrees to have a buffer strip between <br />the residential and commercial properties but that no distance has <br />been indicated.
