Resolution No. 2146 was then entered and adopted recommending <br />approval of the negative declaration to the City Council as <br />motioned. <br />A motion was then made by Commissioner Jamieson, seconded by Com- <br />missioner Doherty that the property described in case RZ-79-17 be <br />rezoned from the RM-1500 District to the R-1-6500 District. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey, Wilson <br />and Chairperson Getty <br />Noes: None <br />Absent: None <br />Abstain: None <br />Resolution No. 2147 was then entered and adopted recommending rezoning <br />of the subject property as motioned. <br />UP-82-1, Robert Geremia & Ed Rethers <br />Application of Robert Geremia and Ed Rethers for a conditional use <br />permit to operate an automobile painting facility at 3830 Old Santa <br />Rita Road. Zoning for the property is C-S (Commercial Service) <br />District. <br />Mr. Harris presented the staff report stating that this matter was <br />continued from 2/10/82 for communications from Mr. Geremia, the <br />property owner. He further stated the staff still feels that this <br />use shouldn't be next to residences. <br />The public hearing was opened. <br />Ed Rethers, 3078 Sandy Way, San Ramon, the proponent in this matter <br />addressed the noise concerns. <br />Chairperson Getty inquired as to whether or not the proponent had <br />read the staff report. Mr. Rethers said he left it at home but had <br />read the contents. He said he doesn't believe the tenants in the <br />residences would object to his proposal. <br />Commissioner Doherty indicated that one of his concerns was that <br />he wanted to know what Mr. Geremia wanted to do with the apartments <br />and this matter was not covered in the letter from him. He said he <br />obviously will make no commitment about the apartment however, Mr. <br />Rethers has been working on his own cars and to his knowledge the <br />City has never received any complaints. <br />Commissioner Wilson said that Mr. Rethers had cleaned up all of the <br />junk and wrecks on the property and now wants to legitimize his <br />operation. He indicated he has no problem with the proposal at <br />all. <br />David Geremia, 2560 Walnut Drive, Walnut Creek, spoke to the proposal. <br />He said the spray booth will be located 50 yards away from the apart- <br />ments and the working hours will be 8:00 a.m.-6:00 p.m. <br />-7- <br /> <br />
