UP-82-9, John Hurwitz, et al <br />Application of John Hurwitz, Robert Slover, and TAM Investments, <br />Inc. for a conditional use permit to operate a food store approxi- <br />mately 1,000 sq. ft. in size specializing in fish products at <br />3059 Hopyard Road (Hopyard Village). The property is zoned C-C <br />(Central Commercial) District. <br />Mr. Harris explained the staff report. He indicated the shopping <br />center was somewhat short of parking spaces and that he discussed <br />this matter with Arnold Lenk of Tam Investment today. He stated <br />that Mr. Lenk will be coming back to the Planning Commission soon <br />with a proposal to remedy the situation. Mr. Harris indicated <br />that there are sufficient parking spaces at this time for parking <br />for the proposed fish market. <br />The public hearing was opened. <br />John Hurwitz, 2179 Goldcrest, Pleasanton, addressed the Commission. <br />He stated that one of the conditions imposed on his proposal is to <br />withhold the building permit until the parking lot of the center <br />is striped. He said it is their intention to be done by September <br />and asked that the striping be required prior to occupancy instead <br />of prior to issuance of the building permit. <br />Chairperson Lindsey said the request appears to be a reasonable <br />one and that the striping should probably be done prior to opening <br />of the market. Mr. Harris indicated that staff has no problem with <br />this change. <br />Mr. Harris stated that Mr. Lenk will be coming in for a variance <br />to allow 40~ compact parking and this would give them more parking <br />spaces than originally planned and that the staff does intend <br />to look into a change to the ordinance which would allow compact <br />parking. He further stated that compact parking has previously <br />been allowed in the C-R and PUD Districts. He indicated that about <br />13/14 parking spaces would be added to the project by allowing this. <br />Commission Jamieson made a comment that a fish market is needed <br />in our town, asked whether or not the applicant had stores in <br />other towns. <br />Mr. Harris indicated that the parking analysis provided to the <br />Commission includes the entire shopping center. <br />The public hearing was closed. <br />A motion was made by Commissioner Jamieson, seconded by Commissioner <br />Wilson that findings shown in the staff report are made and that <br />case UP-82-9 be approved per the conditions in the staff report <br />modifying No. 2 to allow that striping be completed prior to <br />occupancy and not prior to issuance of building permit. <br />-9- <br />._....._... _ __ . _ _._._.____. .__.- ....., ... ,.____. __._... .__ ..._. __ ._ ._.___. __....r. <br />
