ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson, Wilson and <br />Chairperson Lindsey <br />Noes: None <br />Absent: None <br />Abstain: None <br />Resolution 2185 was entered and adopted approving case UP-82-9 <br />as motioned. <br />AP-82-4, Philip Younger <br />Appeal of an action of the Zoning Administrator (PUD-82-11) <br />approving a minor modification to PUD-80-8 that would delete the <br />requirement for a solid masonry wall and substitute a wooden <br />fence to be constructed along the northern property line of a <br />34 unit townhouse project on the north side of Black Avenue between <br />Harvest Road and Crestline Road. Zoning for the property is PUD <br />(Planned Unit Development)-High Density Residential District. <br />Mr. Harris reviewed the staff report explaining the reason for the <br />request. <br />The public hearing was opened. <br />Philip Younger, appellant, stated the only reason he supported the <br />development in the first place was because there would be a masonry <br />wall. He said the issue of saving the trees is not necessarily <br />so in that Morrison's development right across the street has a wall <br />which was worked around the trees with success. He further stated <br />there will be a pool close to this area and it would be real close <br />to the fence. <br />Jean Valerga, 5290 Ridgevale Way, concurred with the statements of <br />Mr. Younger. She said the remaining trees have been trimmed and <br />will not provide a proper buffer. <br />Jim Price, the developer explained why he wants a fence and that <br />his subcontractors said they didn't want to be responsible for damage <br />to any trees. He said this is because of the excavation for footings <br />so close to the proposed wall. He further said Morrison's trees are <br />further apart than the ones for his development. He passed out a site <br />plan for the Commission and audience to see. He said that his <br />development is like a single-family area and not like Morrison's and <br />that their parking will be all internal and not separate. He further <br />said there are no windows on the second floor facing the north <br />side. He further said someone had cut down trees in his development <br />without his knowledge or approval. He said this is also in violation <br />of the Heritage Tree Ordinance. He said normally walls are not <br />required between one residential subdivision and another. <br />Commission Wilson asked who cut down the eight trees. Mr. Price <br />said he had no idea, but it certainly wasn't him. He said the <br />property is more marketable with tall trees and he pledged to save <br />the trees at the time of his project approval. <br />-10- <br />
