Commissioner Getty asked about a soundwall for the project. bTr. Harris <br />explained that condition No. 3 of the staff report requires that the <br />developer do whatever is necessary to bring the noise level down to <br />60 dba Ldn. Commissioner Jamieson then asked who would designate which <br />acoustical expert to hire. He indicated that he felt the City should <br />do it. Mr. Harris stated that the City recommendation would have <br />to be followed. <br />Commissioner Doherty then spoke to other areas in Santa Clara County <br />where the State has had to go back and install soundwalls. Mr. <br />Harris said a wall may end up not being the only thing required. <br />He said the developer may have to glaze or take whatever measures <br />to reduce the noise level as determined by the noise study. <br />The public hearing was opened. <br />Doyle Heaton, 2291 Via de Mercado, Concord (the applicant), addressed <br />the Commission. He stated they agree with the conditions imposed <br />by the staff including the ones mentioned earlier in the evening. <br />He said they will do whatever necessary to attenuate noise. <br />Commissioner Wilson asked if the houses would be single-story <br />where they back up to the freeway for the six lots. Mr. Heaton <br />said they would be. Mr. Heaton said the lots would be very large <br />because some of the area on the lots are unbuildable because of <br />public easements. <br />Commissioner Jamieson said he feels that building so close to the <br />freeway is not a good idea because of the noise even if it is a <br />case of 'buyer be aware'. He said he feels very strongly about <br />this point. Mr. Heaton said there is a 50 ft. easement and soundwall <br />proposed. Commissioner Jamieson said this would not change his <br />mind. <br />The public hearing was closed. <br />A motion was made by Commissioner Doherty, seconded by Commissioner <br />Getty that the mitigated negative declaration prepared for Tract 4901 <br />be approved inasmuch as conditions imposed on project approval would <br />reduce any significant adverse environmental effects to insignificant. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Wilson and Chairperson Lindsey <br />Noes: Commissioner Jamieson <br />Absent: None <br />Abstain : iQone <br />Resolution No. 2192 was then entered and adopted approving the <br />mitigated negative declaration as motioned. <br />-17- <br /> <br />
