A motion made by Commissioner Getty, seconded by ~ .iissioner <br />~4ilson that the negative declaration prepared for Tract 5037 be <br />adopted inasmuch as approval of the tract will have no significant <br />adverse effect on the environment. <br />ROLL CALL VOTL <br />Ayes: Commissioners Doherty, Getty, Jamieson, tiailson and <br />Chairperson Lindsey <br />Noes: None <br />Absent: None <br />Abstain : IJone <br />Resolution No. 2190 was entered and adopted approving the negative <br />declaration for Tract 5037 as motioned. <br />A motion was then made by Commissioner Getty, seconded by Commissioner <br />Jamieson, that Tract 5037 be approved per the conditions of the <br />staff report with the following additions: <br />4. That the developer acknowledge that tine City of <br />Pleasanton does not guarantee the availability of <br />sufficient sewer capacity to serve this development <br />by the approval of this case and that the developer <br />acknowledge that building permit approval may be <br />withheld if sewer capacity is found by the City no;: <br />to be available. <br />5. That the developer (subdivider) may file miltiple final <br />maps prior to the expiration of the conditionally approved <br />tentative map for this development; provided, however, <br />that each such final map filed shall provide for all <br />normal and reasonable public improvements required by <br />the City to serve that portion of this development to <br />the satisfaction of the City Engineer. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson, Wilson and <br />Chairperson Lindsey <br />Noes: None <br />Absent: None <br />Abstain: None <br />Resolution No. 2191 was then entere3 and adopted approving Tract <br />5037 as motioned. <br />Tract 4901, Vintage Associates <br />Application of Vintage Associates for the subdivision of approxi- <br />mately 45 acres into 192 parcels, with a minimum parcel size of <br />6,500 sq. ft. located in an area generally bounded by I-580, the <br />Alameda County Flood Control District (Zone 7) Drainage Channel, <br />LJest Las Positas Boulevard, and the Pleasanton City limits. Tlie <br />e~cisting zoning is R-1-6500 (Single-Family Residential) District. <br />A negative declaration of environmental impacts will also be con- <br />sidered. <br />Dir.
