The public hearing was opened. <br />Brad Hirst, 2456 Minivet Court, asked that this matter be viewed <br />through the eyes of the established merchants and stated that in <br />view of the current economic conditions some emotional responses <br />might be forthcoming. Mr. Hirst spoke to the following and asked - <br />1) how would the City enforce any changes to the ordinance and what <br />would be the remedy for violating it. He said it is pretty hard <br />to get an established remedy; 2) he complimented the staff because <br />it applies to all commercial districts; 3) he asked that parking <br />lot circuses, rides and amusement displays be prohibited. <br />He asked about drive-ins as described in proposed ordinance and <br />whether it meant a 1950s type or whether you are talking about <br />food establishments with take out windows. He further asked that <br />some method of allowing individual merchants to display their <br />merchandise for anniversary sales, etc should be included. He <br />said perhaps in a shopping center all merchants wouldn't want <br />to participate in an anniversary special. <br />Mr. Hirst further suggested that a bike/ped crossing be put between <br />shopping centers. He recommended that the proper committee look <br />into this. <br />Commissioner Getty said that demonstrations or displays, parti- <br />cularly for the core area, should be considered also. <br />This matter was then continued to 7/28/82. <br />Tract 4805, Castlewood Properties <br />Application of Castlewood Properties, Inc. for a one year extension <br />for tentative map, Tract 4805, for a proposed 11 lot single-family <br />townhouse subdivision of approximately 7 acres of land at the south- <br />west corner of Pico and Vineyard Avenue. The property is zoned PUD <br />(Planned Unit Development)-Medium Density Residential District. <br />Mr. Harris stated that this extension should be withdrawn because <br />the Subdivision Map Act allows a tract to run for two years, not <br />one as the City Ordinance does and the City cannot impose any <br />stricter regulations than the Map Act. <br />Tract 4914, Vermillion Development Company <br />Application of Vermillion Development Company for tentative subdivision <br />approval for 21 lots on approximately 2.3 acres of land located on <br />the north side of the Del Valle Parkway, just west of Valley Community <br />Church. Zoning for the property is PUD (Planned Unit Development)- <br />Medium Density Residential District. <br />Mr. Harris stated that he would like to add condition No. 26 relating <br />to the sewer disclaimer condition to this proposal. Mr. Warnick <br />stated he would like to add condition No. 27 to this and other tenta- <br />tive maps to be considered tonight. The conditions are as follows: <br />-12- <br />
