Commission Wilson then asked if a concrete fence was erected and <br />the trees died on the property if the developer was liable because of <br />it. Mr. Price said that he would be as far as he knows. <br />Commissioner Getty said it would be to the City's benefit to have a <br />long-lasting masonry wall as opposed to a fence with a very limited <br />number of years. <br />Commissioner Doherty indicated that every effort should be made to <br />determine who cut down the trees on the Price property and take what <br />ever action necessary for prosecution. <br />Darlene Richards, 1924 Harvest Road, asked that a masonry wall be <br />constructed for a noise buffer, but that her main concern is who <br />would maintain the wooden fence if it were constructed instead. She <br />said the fence installed around her house needs maintenance. <br />B. Malinski, 5278 Ridgevale Way, suggested that the trees were <br />removed from the Price project at the request of the property owner, <br />Mr. Morrison. She said the area of the trees was a collection <br />center for trash and they were, in fact, damaged. <br />The public hearing was closed. <br />A motion was made by Commissioner Getty, seconded by Commissioner <br />Wilson that the appeal of Philip Younger (AP-82-4) be upheld and that <br />a masonry wall be constructed around the Price development as ori- <br />ginally conditioned. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson, Wilson and <br />Chairperson Lindsey <br />Noes: None <br />Absent: None <br />Abstain: None <br />Resolution No. 2186 was then entered and adopted upholding the <br />appeal of Philip Younger regarding case PUD-80-8 and that a <br />masonry wall shall be constructed on the northern perimeter of <br />the development. <br />RZ-82-10, City of Pleasanton <br />Application of the City of Pleasanton to amend Article 8, and related <br />portions of Chapter 2, Title II of the Ordinance Code of the City <br />of Pleasanton to further define regulations related to outdoor sales. <br />The Planning Commission may recommend any action regarding this <br />matter consistent with the General Plan. <br />Mr. Harris stated that the public hearing should be opened on this <br />item but that it should be continued to 7/28/82 for further modi- <br />fication to the proposed ordinance change.
