26. That the developer acknowledge that the City of <br />Pleasanton does not guarantee the availability of <br />sufficient sewer capacity to serve this development <br />by the approval of this case, and that the developer <br />agrees and acknowledges that building permit approval <br />may be withheld if sewer capacity is found by the City <br />not to be available. <br />27. That the developer (subdivider) may file multiple <br />final maps prior to the expiration of the conditionally <br />approved tentative map for this development; provided, <br />however, that each such final map filed shall provide <br />for all normal and reasonable public improvements <br />required by the City to serve that portion of this <br />development to the satisfaction of the City Engineer. <br />The public hearing was opened. <br />Dave MacLellan, Vermillion Development Corporation, spoke asking about <br />fees in condition No. 14 because the fees are scheduled to increase <br />and the project was held up because of the Growth Management Ordinance <br />and their project was ready to go in August. Concerning condition <br />No. 21 he said they would like to retain the architecture in the <br />project and asked that the light standards be of a Victorian style as <br />opposed to a galvanized pole. Mr. Warnick stated that the staff has <br />no particular problem with this request. Mr. Warnick further stated <br />that with regard to fees we don't have any control over them and that <br />in fact the standards are governed by the City Council and Zone 7 <br />based upon what the costs are to Zone 7 and the City. Commissioner <br />Wilson said a big can of worms would be opened if fees were modified <br />for one developer. <br />Commissioner Jamieson asked about restricting the access and the <br />reason for the request. Mr. Warnick explained. <br />The public hearing was closed. <br />A motion was made by Commissioner Wilson, seconded by Commissioner <br />Getty that Tract 4914 be approved per the staff report of 6/24/82 <br />amending conditions as requested of staff and allowing the developer <br />to use Victorian-style lighting as approved by the City Engineer. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson, Wilson and <br />Chairperson Lindsey <br />Noes: None <br />Absent: None <br />Abstain: None <br />Resolution No. 2187 was then entered and adopted approving Tract <br />4914 as motioned. <br />-13- <br />
