Page 2 <br />RZ-82-10, City of Pleasanton <br />Application to amend various sections of the Code as they pertain to <br />the outdoor sales and display of merchandise. <br />Mr. Harris reviewed the staff report and recommendation of approval <br />and stated heretofore there was no allowance in the Code for outdoor <br />sales in general. <br />Commissioner Getty asked about the cost of the permit for outdooor sales. <br />Mr. Harris said it would be a nominal amount and that current fees for <br />temporary conditional use permits range from $15-$25. <br />Commissioner Getty further asked how they would control non-profit <br />outdoor sales. Mr. Harris indicated he would hope that no one would <br />abuse the privilege and if they did, the ordinance would have to be <br />tightened up. He further said that the Downtown Association supported <br />sales three times per year. <br />Commissioner Doherty addressed the Amador Center in that it seems to <br />him that Carl's, Grutmans and other tenants have sidewalk sales frequently. <br />He stated they also have artists' sales frequently. Mr. Harris stated <br />that these would be regulated under the proposed ordinance. Commissioner <br />Doherty asked who was notified of the proposed change. The recording <br />secretary explained. Mr. Harris further said that Mr. Rapp, owner of <br />the Center, received a copy of the proposed change. <br />The public hearing was opened. <br />Lynn Bach, one of the tenants of the Amador shopping center indicated <br />that all tenants were notified of the meeting and proposed change. She <br />indicated they would be happy with a three-time per year restriction <br />with regard to outdoor sales. She asked if this would include artists' <br />shows. Mr. Harris said that they are currently allowed under a temporary <br />use permit in the C-N District and that this would not be changed. <br />Commissioner Doherty asked if anyone else was present in the audience <br />from that shopping center. No one else addressed the Commission. <br />Commissioner Getty indicated that a display doesn't necessarily mean <br />they are selling the items. Mr. Harris indicated that a display would <br />be covered in this ordinance. <br />Commissioner Doherty asked about Rod's Hickory Pit and the ice cream parlor <br />who share tables and chairs outside of their premises. Mr. Harris <br />stated the proposed ordinance allows outdoor restaurants. <br />Commissioner Getty talked about an attractive display of merchandise <br />being shown outside of a building. Mr. Harris discussed the fact that <br />it is pretty hard to separate an attractive display for an unattractive <br />one in an ordinance. <br />Commissioner Doherty spoke to the truck load sales various shopping <br />centers conduct. Mr. Harris indicated the ordinance is being written <br />to restrict these types of things. <br />
