PUD-82-10, Harris Realty and Mildred Vallarino <br />Application of Harris Realty and Mildred Vallarino for Planned Unit <br />Development (PUD) development plan approval for an 88 unit multi-family <br />complex on an approximately 4.7 acre site located on the north side <br />of Vineyard Avenue opposite Amador Court. Zoning for the property <br />is PUD (Planned Unit Development)-High Density Residential District. <br />The Planning Commission may recommend any action regarding this matter <br />consistent with the General Plan. A negative declaration of environ- <br />mental impacts was also considered. <br />Mr. Harris presented the staff report and explained the differences <br />between this proposal and the one previously approved on the project. <br />Commissioner Getty asked if these units would be converted in 10 years. <br />Mr. Harris stated that it is not automatic but that the developer can <br />certainly apply for condominium conversion at the end of that time. <br />Commissioner Getty felt that 800 sq. ft. is quite small. She asked if <br />the Fire Department had any problems with the exterior of the units. <br />Mr. Harris stated they liked these better than the ones with the <br />shake roofs. <br />Mr. Harris indicated that condition number 5 should be modified <br />to read as follows: <br />Condition No. 5 <br />That approval of case PUD-82-20 shall not become effective <br />until ninety (90) days after the small project allocation <br />of the Growth Management Plan has taken place for 1983 and <br />during that ninety day period the applicant may apply to <br />the City Council to rescind its approval of case PUD-82-20, <br />in which event case PUD-81-32 would remain in full force and <br />effect. <br />Commissioner Jamieson asked about the homeowners association. <br />Mr. Harris said there would be none at this time because the units <br />are proposed to be rented. He indicated that in 10 years when and <br />if the property is converted, a homeowners association would be <br />established at that time. <br />The public hearing was opened. <br />Mr. Harris referred to a letter distributed to the Commissioners <br />and others from Mr. Pruett on Vineyard Avenue in opposition to this <br />project. <br />Mike Harris, 6111 Johnson Drive, Pleasanton, the developer addressed <br />the reasons for the change of square footage in the units from 1200 <br />to 800 and from 61 to 88 total units. <br />-8- <br />
