i <br /> <br />A motion was made by Commissioner Wilson, seconded by Commissioner Doherty, <br />to deny case PUD-82-17. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Wilson and <br />Vice Chairperson Jamieson <br />Noes: None <br />Absent: Chairperson Lindsey <br />Abstain: None <br />Resolution No. 2223 was then entered and adopted denying case PUD-82-17 <br />because of lack of agreement concerning public improvements required. <br />The applicant was then informed by the Vice Chairperson that he had <br />15 days in which to appeal this decision to the City Council. <br />UP-82-16, Robert R. Kenny <br />Application of Robert R. Kenny to operate a public auction facility at <br />3440 Stanley Boulevard, specializing in used furniture, appliances <br />and antiques. Zoning for the property is C-S (Commercial Service) <br />District. A negative declaration of environmental impacts was also <br />considered. <br />Mr. Harris presented the staff report. <br />Commissioner Getty asked how many businesses are open evenings in the <br />area. Mr. Harris explained that there are existing businesses in the <br />area that are primarily repair shops, etc. which close between 5:00- <br />7:00 p.m. Commissioner Getty then asked who would be running the food <br />concession. <br />Commissioner Doherty indicated he would be more comfortable about the <br />proposed use if it were to be reviewed annually based upon the fact that <br />the area is not yet built up. Commissioner Getty agreed with this. <br />Commissioner Wilson stated he would like to know the cost of setting up <br />the business and said he would like the applicant to reply to this. <br />Commissioner Getty felt that if the auction is successful there might be <br />support businesses going up in that area and use of parking in that area. <br />Mr. Harris indicated that the area is developing slowly. <br />Commissioner Jamieson addressed the fact that there is nothing in the <br />proposed conditions which limits the auctions to evenings. Mr. Harris <br />indicated that this is a good point. <br />The public hearing was then opened. <br />-5- <br />
