Vice Chairperson Jamieson asked for staff guidance at this point. Mr. <br />Warnick reiterated that standard procedure is to require improvements <br />or a deferment agreement if it looks like something that would later <br />be taken care of and felt the owners should get together and work <br />something out because it is not fair for the City to have to pay for <br />improvements and that when people create new lots they should con- <br />tribute toward improvements required. <br />Mr. Harris stated he didn't know whether or not the Hempys have <br />talked to the Starnes about bearing the burden of the improvements. <br />Mr. Hempy said this is out of the question and that the Starnes bought <br />a piece of property with a home on it for a nice view and that they <br />discussed this a little bit, but the dedication by Starnes is out of the <br />question. Mr. Starnes then stated from the audience that the cost would <br />be so prohibitive, Hempy wouldn't profit by purchasing this section <br />for dedication purposes. <br />Commissioner Getty asked how far from the front of the Starnes house <br />the 33 ft. dedication would be. Mr. Starnes indicated the map would <br />have to be checked. Commissioner Wilson asked how long ago the trees <br />had been planted within the 33 ft. strip. Mr. Starnes indicated they <br />had been planted probably just prior to his purchasing the property or <br />about three years ago. Commissioner Getty then asked if the Starnes <br />house was elevated or raised. Mr. Starnes said it is about 15 ft. <br />or so over the level of Foothill Road. <br />Rick Hempy indicated a 15 ft. retaining wall would have to be built and <br />that on a slope that would be about 15 ft. from the Starnes' house. <br />Mr. Harris then explained what would happen to the property and slope <br />if the property were to be condemned and that if at some point Foothill <br />is widened the property would be sloped. <br />Mr. Hempy indicated that three years ago when the Starnes purchased the <br />house they came to the City and asked if Foothill would be widened and <br />the City said no. <br />Vice Chairperson Jamieson said this is rather an intangible thing to <br />ask. Commissioner Wilson concurred that to know who told the Starnes <br />this would have no bearing on anything because it would depend upon how <br />the question was asked. <br />Commissioner Wilson then asked if the applicant wanted to withdraw <br />from this hearing to work something out with the other property owners. <br />Mr. Hempy said no he would prefer an action be taken. <br />The public hearing was closed. <br />-4- <br />
