Mr. Warnick said he had no problems with condition No. 18 as stated. <br />Concerning No. 23, Mr. Harris stated that this is entirely up to <br />the Police Department. <br />Commissioner Getty asked if this condition couldn't merely state <br />that "All lighting shall be approved by the Police Department. <br />Mr. Sieglietz, said he understands condition No. 28 is a standard <br />one, but they have won the Affordable Housing Competition. <br />Mr. Swift said that Mr. Sieglietz is correct in that there will <br />be an agreement entered into between the City and the developers <br />of Quail Creek but that the City does not guarantee sewer capacity <br />because if the City, through some unforeseen reason has to issue <br />a cease and desist order, they don't want to be bound by a sewer <br />capacity availability promise. It was agreed by the Commissioners <br />that this condition would stand as proposed by staff. <br />Mr. Sieglietz discussed condition No. 32 regarding streets. He <br />suggested the condition read as follows: "That the developer construct <br />streets within the project to City standards and deed them to the <br />City." Mr. Warnick then discussed the original design of the streets <br />as previously proposed and that the developer had changed them to <br />conform to the City's request. <br />Vice Chairperson Jamieson asked what the annual cost to the tax <br />payers would be to maintain these new streets. <br />Mr. Warnick stated that for the first year there wouldn't be any <br />cost. He said that in a typical residential subdivision the City <br />does accept streets and that the streets proposed are up to <br />standard. <br />Mr. Sieglietz indicated that their engineer is in the audience <br />to discuss any specifics regarding the streets. He urged approval <br />of the project and stated it would add much to the community. <br />Commissioner Wilson asked that since the City Council turned this <br />project down twice, how did the developers get them to change <br />their minds. Mr. Sieglietz explained that they were the winner of <br />the Affordable Housing Competition. He explained the developer <br />was still interested in competing in the Affordable Housing Com- <br />petition even though their PUD application was denied and that they <br />didn't compete in the program initially because of a misunderstanding <br />between the staff and applicant. <br />The public hearing was opened. <br />Ron Schneider, 650 Orofino Court, spoke in opposition to this <br />development. He said this is essentially the same project that was <br />twice denied. He read a letter which he had presented to the City <br />Council and gave a copy to the Clerk for records. He stated that, <br />in his opinion, the City gave in because of a threat of law suit. <br />He asked that the improprieties of this matter be resolved. <br />-16- <br />
