However, Co <br />missioner Shepherd indicated he would! <br />be inclined to favor sound planning <br />concepts (zoning the property for its <br />desired future use) but conditioning <br />such zoning to minimize the risk of <br />later suits due to the City's possiblE <br />inability to provide sewer service. <br />Deputy City Attorney Levine stated <br />that it is difficult to predict how <br />the courts would react, but it is <br />possible that the more developments <br />in a given area are approved, the <br />'better the developer's chances of re- <br />ceiving a good judgment from the court <br />A resolution was then entered and <br />adopted accepting the E.I.R. <br />A resolution was entered and adopted <br />recommending to City Council adoption <br />of RZ-74-12, adding three conditions <br />plus a fourth condition regarding in- <br />sufficiency of sewer capacity. <br />Evangelical Free Church - application <br />for a conditional use permit to allow <br />the use of 9.5 acre parcel of land <br />located on the east side of Valley <br />Trails Drive midway between Virgin <br />Islands Court and Yosemite Court SoutY <br />for the construction and operation of <br />a church and related facilities. <br />Zoning for the property is P (Public <br />and Institutional) District. <br />-5- <br />Res <br />Sec: <br />Ayes: <br />Noes: <br />Absent: <br />,Abstain: <br />. .. _,.__..._._.._.__._~._.__ ... ............ .. ..__....... __...... _. .. ...._........-r __.., ._. .. _.. .~ .. .... _....._.... .. ...._.,,_.._... _.. _..... _.... _... .,~ .......... _... _...... ....._ .....___ ......._. _..... ._. _....-. <br />
