This matter was then tabled while <br />considerably more work was done. The draft now submitted appears to <br />meet staffs concerns. <br />The Public Hearing was opened. Mr. Deryl Houser, 4545 Second Street, <br />expressed approval to the revision proposed. <br />The Public Hearing was then closed. <br />The Commissioners concurred with the revised draft and adopted Resolu- <br />tion 1458 recommending to the City Council the adoption of revised <br />Article 20. <br />Roll Call Vote <br />Resolution: Commissioner Shepherd <br />Seconded: Commissioner Jamieson <br />Ayes: Commissioners Doherty, Jamieson, <br />Noes: None <br />Absent: Commissioner Wood <br />Abstain: None <br />Shepherd and Chairman Butler <br />MATTERS FOR COMMISSION'S REVIEW <br />AP-76-8, Deryl Houser - appeal to a decision of the Zoning Administrator <br />denying a home occupation to allow the manu acturing o handicra t <br />items from a rest ence at 45 5 Secon Street; zoning or the property <br />is RM-4000 District. <br />Mr. Houser was present and explained the reason why he was originally <br />denied by the City, that being, because his landlord objected to him <br />conducting the handicraft business from his residence. However, his <br />landlord has since rescinded his objection and the City is now bringing <br />the matter before the Planning Commission for their review. He pre- <br />sented two exhibits of the kind of work he does. Since the initial <br />opposition to this request has been removed, the Commissioners felt <br />that, with proper controls, this use would not cause detriment to the <br />neighborhood. They adopted a motion allowing Mr. Houser to conduct <br />the handicraft business from his home at 4545 Second Street. <br />Roll Call Vote <br />Motion: Commissioner Doherty <br />Seconded: Commissioner Shepherd <br />Ayes: Commissioners Doherty, Jamieson, <br />Noes: None <br />Absent: Commissioner Wood <br />Abstain: None <br />Shepherd and Chairman Butler <br />Request of Thomas Richert to utilize property adjacent to the Casa <br />Ver e Nursery at 5511 Sunol Boulevard for a landscaping materials use; <br />zoning for the property is I-P (Industrial Park) District. <br />Secretary Harris described the staff report. He felt that this request <br />could be found td be in substantial conformance with the nursery <br />operation next door. He stated that the applicant would need to apply <br />for a conditional use permit for a modification to the nursery. He <br />emphasized that the staff would not like to see the nursery turned into <br />a lumber or building materials yard. <br />Mr. Richert was present with the owner of Casa Verde Nursery, Larry <br />Billings, and stated that he proposes to tie in his operation with the <br />nursery with the materials he intends to stock primarily to complement <br />landscaping work. He would not be contracting for installation of <br />decks, etc., and would not be renting tools, etc. <br />-6- <br />
