TENTATIVE SUBDIVISION MAPS <br />Tentative Tract 3787, application of Dean Wagerman to convert 42 apartment <br />units located at 4327-4421 Fairlands Drive to condominiums. <br />Staff recommendation is for approval. <br />Deputy City Attorney Harvey Levine indicated that as of January 1, 1977, <br />State law requires that the existing residents of apartments which have <br />been converted to condominiums have first option within a certain number of <br />days to purchase the units and all residents be given four months notice <br />before requiring them to vacate a building being converted. <br />Present at the review was Mr. Dean Wagerman, the applicant. Mr. Wagerman <br />indicated complete agreement with staff recommendations. <br />Commissioner Wood raised questions regarding maintenance and upkeep and <br />whether all of these requirements are covered in the codes, covenants and <br />restrictions for that development. Mr. Levine stated that this information <br />plus the budget will be submitted to the City Attorney's office for review <br />and approval,by Mr. Wagerman. The guidelines have been received from the <br />Department of Real Estate. <br />Commissioner Wood wanted assurances that no problems would occur to the new <br />owners. Commissioner Doherty indicated that the City Attorney's office <br />should continue with their procedures, but that the Commission should look <br />at the budget and the C C & R's of this project. <br />Mr. Levine stated that his office would be glad to circulate the C C & R's <br />and the budget to the Commission for comments. In a related matter, Mr. <br />Levine indicated that the City Attorney's office reviews all C C & R's <br />to insure that the City be empowered to enforce the requirements contained <br />in those C C & R's. <br />Commissioner Jamieson asked about the requirement of painting the premises. <br />Mr. Harris indicated that painting requirements would only apply to the <br />exterior of the buildings. <br />Mr. Wagerman, upon inquiry from Commissioner Wood, stated that hopefully <br />the selling price of the two-bedroom units would be in the low thirties <br />($30,000) . <br />Resolution No. 1486 was entered and adopted approving Tentative Tract 3787 <br />with a modification to Condition No. 2 requiring that the C C & R's and <br />budget be distributed by the City Attorney to the Planning Commission for <br />comments, prior to City Attorney action; that Condition No. 4 be revised to <br />indicate "outside of buildings" will be repainted; and that no negative <br />findings were made which would cause the Commission to deny this tentative <br />tract map. <br />Roll Call Vote <br />Resolution: Doherty <br />Seconded: Wood <br />Ayes: Doherty, Jamieson, Shepherd, Wood, Chairman Butler <br />Noes: None <br />Absent: None <br />Abstain: None <br />-8- <br /> <br />
