The staff report was described by Secretary Harris. He recommended Alter- <br />nate 1. <br />The Public Hearing was opened. <br />Amelia Wilcox, 471 Bernal Avenue, spoke. Her property which is zoned RM-1500 <br />is across the street from this proposed action. She requested clarification <br />of nonconforming uses which might occur on the property, and how her pro- <br />perty would be affected by the zone change. She worried that the City <br />could employ its power of eminent domain and tear down the houses if it <br />chose to. Deputy City Attorney Harvey Levine assured her that the zone <br />change would not add any new powers to the City, that existing uses could <br />continue as nonconforming uses. <br />Next, a Mr. Mark Chatney, 248 W. Angela Street spoke. He did not receive <br />a notice of the hearing, having just moved there six months ago. He felt <br />that because business uses had been established in a house adjoining his, <br />he should also be allowed to locate a business at that address if he wished. <br />He was opposed to the zone change. He requested clarification of a non- <br />conforming use, and required parking. <br />The Public Hearing was closed. <br />Chairman Butler indicated that the proposal by staff would basically retain <br />the character of the neighborhood. He tended to agree with the staff <br />that there are some nice, older buildings and their owners may be more <br />encouraged to renovate these structures rather than have the homes torn down <br />and replaced with commercial development. <br />Secretary Harris indicated that if the Commission agrees to go along with <br />staff recommendation for Alternate 1, Exhibit B, they should also find that <br />this zoning change is in conformance with the General Plan. <br />Resolution No. 1482 was then entered and adopted recommending to Council <br />that the rezoning amendment be approved per staff recommendations as shown <br />on Alternate 1, Exhibit B, and that this rezoning would be in conformance with <br />the General Plan. <br />Roll Call Vote <br />Resolution: Wood <br />Seconded: Jamieson <br />Ayes: Doherty, Jamieson, <br />Noes: None <br />Absent: None <br />Abstain: None <br />Shepherd, Wood, Chairman Butler <br />RZ-76-26, City Council - application for an amendment to Article 2, Chapter 2, <br />Title II of the Ordinance Code of the City of Pleasanton with respect to the <br />definitions of various food markets, including but not limited to convenience <br />markets, supermarkets and specialty markets, and for an amendment to Sec. <br />2-7.08(a), Article 8, Chapter 2, Title II of the Ordinance Code to redesignate <br />the various classifications of food stores as either permitted, or condi- <br />tionally permitted uses in the C-N (Commercial Neighborhood), C-C (.Central <br />Commercial) and/or C-R (Commercial Regional) Districts. <br />-4- <br />
