Secretary Harris indicated that the Planning Commission can approve or make <br />a minor modification to the conditional use permit without having to <br />advertise the item first. <br />Resolution No. 1503 was entered and adopted making the finding that a pool <br />supply and service business is similar enough to a nursery/garden center <br />operation to be subsumed under Casa Verde's existing conditional use <br />permit. A minor modification to the permit was then passed to specifically <br />prohibit the sale of swimming pools from 5511 Sunol Boulevard. <br />Roll Call Vote <br />Resolution: Shepherd <br />Seconded: Jamieson <br />Ayes: Doherty, Jamieson, <br />Noes: None <br />Absent: None <br />Abstain: None <br />Shepherd, Wood, Chairman Butler <br />Resolution No. 1507 was then entered and adopted making the following minor <br />modification to UP-76-28: a) That the sale of swimming pools is specifically <br />prohibited as a part of the Casa Verde Garden Center operation; b) That the <br />applicant provide the Commission with a complete review of all present and <br />intended uses bn the subject property; and c) That the Commission be given <br />an opportunity to consider the overall appropriateness of said uses in the <br />I-P District. <br />Roll Call Vote <br />Resolution: Butler <br />Seconded: Shepherd <br />Ayes: Doherty, Jamieson, Shepherd, Wood, Chairman Butler <br />Noes: None <br />Absent : rdone <br />Abstain: None <br />Review of an application for a minor subdivision which would create four <br />lots approximately 15 acres each on approximately 60 acres located east of <br />the present terminus of Arbor Drive. <br />Secretary Harris described the staff report. The executors of the Morris <br />Stulsaft Testamentary Trust wish to subdivide the property into four <br />parcels. They had applied for a minor subdivision and as part of this <br />application, they are asking that the underground utilities requirement <br />of the Subdivision Ordinance be waived, at least temporarily. This waiver <br />can only be given by the Planning Commission since they have the power to <br />grant such a modification. <br />Deputy City Attorney Levine asked the Commissioners to add Condition No. 11, <br />requiring the amendment of the annexation agreement regarding sewer capacity. <br />Mr. Levine would provide the wording for this condition. <br />Mr. Bill Hirst was present to speak for the applicants. He had no problems <br />with the conditions of approval. Also present was their engineer, Gil <br />Barbee, who answered some engineering questions the Commissioners had. <br />The Public Hearing was opened for the negative declaration on the project. <br />No comments were forthcoming and the Public Hearing was closed. <br />-7- <br />
