Roll Call Vote <br />Resolution: Doherty <br />Seconded: Shepherd <br />Ayes: Doherty, Jamieson, <br />Noes: None <br />Absent: None <br />Abstain: None <br />Shepherd, Wood, Chairman Butler <br />r4P,TTERS FOR COMMISSION'S REVIEW <br />Request of Larry Billings for a determination of use not listed for his <br />nursery business known as Casa Verde Nursery at 5511 Sunol Boulevard. <br />Secretary Harris summarized the staff report of March 9, 1977. In addi- <br />tion to the nursery business, Mr. Billings is operating a pool supply <br />operation. Additionally, he had other requests for possible additions of <br />what he considered to be related nursery business uses such as florist, <br />patio furniture sales, mini-storage. It was staff's feeling that a good <br />way to handle this situation is rather than come in on a piece-meal basis, <br />Mr. Billings should make a reasonably firm decision on the kinds of <br />nursery-related uses he is contemplating and submit a master plan to cover <br />the entire property. <br />It was noted that the Code does not speak to uses within a garden center. <br />The main question to be resolved at this meeting is the appropriateness of <br />a swimming pool supply and service operation with a garden or nursery center. <br />It was pointed out that the swimming pool supply and service business is <br />ready to go with a tenant having already entered into a lease agreement with <br />Mr. Billings. <br />Mr. Bill Hirst spoke for Mr. Billings and asked favorable consideration for <br />continuance of the pool supply/service business. He indicated complete <br />willingness on the part of his client to provide the City with an overall <br />master plan for the next few years of the uses he would consider as com- <br />patible with a garden center operation, also he would provide the City <br />with an overall plan of the existing uses. He assured the Commissioners <br />that all equipment and supplies for the pool business would be kept within <br />enclosures. <br />It appears that there are misunderstandings between the applicant and staff <br />as to the semantics of what types of uses would usually be found in a <br />nursery. <br />The Commissioners expressed concern with the piece-meal addition of business <br />to what started out as a nursery operation. They were uncomfortable with <br />the manner in which the "related" garden center businesses were being added <br />to the original site. <br />Chairman Butler asked if "swimming pool supplies" was listed in the Code. <br />Deputy City Attorney Levine said no but noted that the Code lists "swimming <br />pool sales and service" as a separate category from. both a garden center <br />and a garden shop. <br />-6- <br /> <br />
