Chairman Butler stated that with the adoption of the precise plan line <br />for the parkway, this action has gone a long way to fixing development of <br />the property. It would be a major change to its development to have to <br />undo this. However, he was sympathetic to the plight of the homeowners. <br />The traffic projections for that street, in his estimation, are still not <br />what one would consider hazardous to live on. <br />Chairman Butler then read the findings required by Section 2-2.50 of the <br />Pleasanton Ordinance Code and Section 66474 of the Government Code which <br />the Commissioners must consider for subdivision maps. The Commissioners <br />agreed that none of the problems spelled out in those sections existed in <br />the project except possibly.- finding (f) "that the design of the subdivision <br />or the type of improvements is likely to cause serious public health pro- <br />blems." They discussed the possibility of health problems caused by the <br />Parkway. Several Commissioners felt the design could not cause substantial <br />environmental damage. The Commissioners discussed a possible correlation of <br />health factors with the number of cars projected to travel on the Parkway. <br />Commissioner Jamieson stated that he felt the word "safety" was included <br />in the concept of public health and asked the Deputy City Attorney for his <br />opinion. Deputy City Attorney Levine stated he did not feel that was the <br />Government Code section, to include the safety question, but the Commissioners <br />could so interpret the section if they made the basis for their interpre- <br />tation explicit. <br />Commissioner Jamieson felt he would find that the design of the project <br />was likely to cause serious health problems. <br />The remaining Commissiners each considered the question of finding (f) and <br />concluded that traffic safety was not a subject of the finding and that no <br />public health problems were likely. <br />Chairman Butler moved that the Commission make the findings required per <br />Government Code that none of the factors listed in the seven categories <br />exists and that the map may be approved. <br />Roll Call Vote <br />Niotion: Butler <br />Seconded: Wood <br />Ayes: Shepherd, <br />Noes: Jamieson <br />Absent: Doherty <br />Abstain: None <br />Wood, Chairman Butler <br />Resolution No. 1530 was then entered and adopted making the required find- <br />ings as provided for under Government Code Section 66474, plus approval of <br />the tentative subdivision map subject to all conditions in the staff report. <br />Roll Call Vote <br />Resolution: Wood <br />Seconded: Shepherd <br />Ayes: Shepherd, Wood, <br />Noes: Jamieson <br />Absent: Doherty <br />Abstain: None <br />Chairman Butler <br />-7- <br />
