i The Public Hearing was closed on the general plan review. Commissioner Doherty wished to know whether the court's decision on Morrison Homes' sewer allocation would be handled separate and apart from those properties coming under the GMP. Mr. Levine indicated this property is not subject to the 1972 agreement terms, but to a separate court judgment. He could not, however, say for sure at this time how the growth management plan would deal with the property. Chairman Butler stated that without really arguing over the merits of the proposal, he liked Secretary Harris's solution to this problem. Commissioner Shepherd indicated some concern over introducing too much flexibility, but that there probably are sufficient safeguards to offset this. Resolution No. 1548 was then entered and adopted recommending to the City Council an amendment to the text of the Land Use Element of the General Plan as noted in quotes on Page 2 of the August 10 staff report. Mr. Levine stated that the Commission could either deny Mr. Frost's application or Mr. Frost could withdraw it. Mr. Frost stated that he would withdraw his application for the general plan amendment as filed under GP-77-2. He then thanked the Commissioners for their concern in not wishing to delay him any further in his development process. UP-77-12, Valley Community Church - application for a conditional use permit to allow the establishment and operation of a church on a 5.3 acre site located on the north side of the Del Valle Parkway immediately west of Amador High School. Zoning for the property is P (Public and Institutional) District. The Public Hearing was opened. Mr. Jerry Loving, architect for the project was present to answer any questions. The Public Hearing was closed.
