i <br />The Public Hearing was closed on the general plan review. <br />Commissioner Doherty wished to know whether the court's decision on Morrison <br />Homes' sewer allocation would be handled separate and apart from those <br />properties coming under the GMP. Mr. Levine indicated this property is <br />not subject to the 1972 agreement terms, but to a separate court judgment. <br />He could not, however, say for sure at this time how the growth management <br />plan would deal with the property. <br />Chairman Butler stated that without really arguing over the merits of the <br />proposal, he liked Secretary Harris's solution to this problem. <br />Commissioner Shepherd indicated some concern over introducing too much <br />flexibility, but that there probably are sufficient safeguards to offset <br />this. <br />Resolution No. 1548 was then entered and adopted recommending to the City <br />Council an amendment to the text of the Land Use Element of the General <br />Plan as noted in quotes on Page 2 of the August 10 staff report. <br />Roll Call Vote <br />Resolution: Shepherd <br />Seconded: Jamieson <br />Ayes: Doherty, Jamieson, <br />Noes: None <br />Absent: None <br />Abstain: None <br />Shepherd, Wood and Chairman Butler <br />Commissioner Doherty wished to ascertain if it is also necessary to recom- <br />mend denial of Morrison Homes application. Mr. Levine stated that the <br />Commission could either deny Mr. Frost's application or Mr. Frost could <br />withdraw it. <br />Mr. Frost stated that he would withdraw his application for the general plan <br />amendment as filed under GP-77-2. <br />He then thanked the Commissioners for their concern in not wishing to delay <br />him any further in his development process. <br />UP-77-12, Valley Community Church - application for a conditional use permit <br />to allow the establishment and operation of a church on a 5.3 acre site <br />located on the north side of the Del Valle Parkway immediately west of <br />Amador High School.
